Municipal Services Department, 7700 Cottonwood Street, Lenexa, Kansas 66216, until 1:00 pm
(local time) on February 24, 2015 at which time bids will be publicly opened and read aloud at
the Lenexa City Hall. Any bid received after the designated closing time will not be considered
and will be returned unopened.
All bids shall be submitted to the Municipal Services Department Customer Service Staff in

(5%) of the total bid, which shall be retained by City of Lenexa, Kansas until a Contract for the
project has been executed. Bid Bonds will be returned to the bidders, with the exception of the
best and lowest and second best and second lowest responsible bidders, within twenty-one (21)
days after their bids are rejected. The bid deposit of the lowest and the second lowest
responsible bidders will be returned when the Performance Bond, Maintenance Bond and
Statutory Bond, each in an amount equal to 100% of the Contract amount; required insurance
certificates and other required documents shall have been furnished and the Contract
Documents have been executed by the successful bidder.
In the event the low bidder is unable to execute the Contract, for whatever reason, within the
time provided in the Notice of Award, City may annul the Notice of Award and the bid deposit
may be forfeited and City shall exercise its legal prerogatives, including, but not limited to,
enforcement of its rights as to the bid security or specific performance.
City reserves the right to accept or reject any and all bids and to waive any technicalities or
irregularities therein. Bids may be modified or withdrawn by written request of the bidder
received in the office of City Clerk, prior to the time and date for bid opening.
From and after the release of this Notice, any party intending to bid on the above referenced
Project, including their officers, employees, agents, or contractors are specifically prohibited
from communicating with any elected or appointed official of the City, directly or indirectly, with
regard to the award of the contract for the Project listed above, except as specifically authorized
by the Instructions to Bidders. Any such unauthorized communication may result in the
automatic disqualification of such bidder.

SECTION 1. Existing Section 5-1019 of the Code of Ordinances of the City of Mission Hills, Kansas,
is hereby amended to read as follows:
5-1019. Adoption of the Building Code
SECTION 1. Existing Section 5-143 of the Code of Ordinances of the City of Mission Hills, Kansas,
is hereby amended to read as follows:
5-143.
Permit Applications for Exterior Work. All permit applications for exterior work filed
pursuant to 5-1025 shall be submitted to the ARB for its consideration and approval after an application has
been properly filed with the City Clerk. No permit shall be issued to the applicant for such a permit without the
approval of the ARB. In the event that the applicant does not request issuance of the permit within one (1) year
from the date the ARB approves the application, or in the event of an appeal of the ARB approval, within one
(1) year from the conclusion of the appeal, the ARB approval will expire.
A.
Incorporation of the Building Code. The International Building Code (IBC), 2012 Edition,
published by the International Code Council, excluding its Appendices, is hereby incorporated by reference as the Building Code of the City of Mission Hills, Kansas, save and
except such articles, sections, parts or portions as are hereafter omitted, deleted, modified
or changed. One official copy of said Building Code, shall be marked or stamped “Official
Copy as Adopted by Ordinance No. 1408,” with all sections or portions thereof intended
to be omitted or changed clearly marked to show any such omission or change and to
which shall be attached a copy of this ordinance, and filed with the City Clerk to be open to
inspection and available to the public at reasonable business hours. Official copies of such
code shall be supplied at the cost of the City to the officials and agencies in the manner
listed and set forth in K.S.A. 12-3010. Subsequent references to the Building Code shall
mean the International Building Code, 2012 Edition, published by the International Code
Council. Should any provision of this Building Code conflict with any other provision of
the Code of Ordinances of the City of Mission Hills, Kansas, then the more restrictive of
the two provisions shall take precedence.
B.
Amendments to the Building Code as Published. The following provisions of the
International Building Code (IBC), edition 2012, shall be omitted, amended, replaced or
supplemented as follows:
SECTION 2. Existing Section 5-145 of the Code of Ordinances of the City of Mission Hills, Kansas,
is hereby amended to read as follows:
5-145. Hearing Procedure.
A. Hearing Before ARB. Except as provided in Section 5‑144, all permit applications for exterior
work filed pursuant to Section 5‑1026 and all other matters referred to the ARB under these Zoning Regulations
shall be considered by the ARB at a hearing to be held at City Hall. All hearings before the ARB shall be open
to the public, provided that the ARB may adjourn to a deliberative or executive session when such action would
not be in conflict with applicable Kansas law.
B. Time for Hearing. After a permit application for exterior work has been properly filed with the City
Clerk, the Chair and the City Clerk shall establish a reasonable date and time for the hearing. If the ARB fails
to act on a permit within sixty (60) days after the permit has been properly filed with the City Clerk, the person
requesting the permit may deem the permit denied; provided, however, that the continuance of a matter shall
serve to extend this time period.
C. Notice of Hearings. For a hearing before the ARB on a building permit application, the applicant
for the permit, owners of adjoining properties within the city limits of the City of Mission Hills, and any other
person requesting notice of the hearing shall be entitled to notice (“persons entitled to notice”). A hearing before
the ARB on a building permit application for a Substantial Construction Matter shall be deemed a “Substantial
Construction Hearing,” and all occupants of residential properties within the city limits of the City of Mission Hills
and located within five hundred feet (500’) of the property for which application is submitted shall receive notice
of the hearing. All persons entitled to notice for a Substantial Construction Hearing shall be mailed a notice of
time, date and place of the hearing at least twenty-eight (28) calendar days prior to the date of hearing. All other
persons entitled to notice shall be mailed a notice of the time, date and place of the hearing not less than five
(5) calendar days prior to the date of such hearing unless such notice is waived by the parties entitled to such
notice. Failure to receive notice of an ARB hearing shall not be a basis for objecting to any action taken by the
ARB at a hearing. Attendance at a hearing, except for the purpose of objecting to the hearing, shall constitute
a waiver of such notice. This notice provision shall not apply to continuances of matters already noticed.

Section 101.1 of the International Building Code, 2012 Edition, is hereby
amended by replacing the words “Name of Jurisdiction” with the words “the
City of Mission Hills, Kansas.”
Section 105.1.3 of the International Building Code, 2012 Edition, is hereby
added to read as follows:
COUNTY LICENSE REQUIRED. All persons undertaking work which requires
a permit as provided in Section 105, or seeking to obtain that permit from
the City, are required to have a currently valid contractor’s license from the
Johnson County Contractor’s Licensing Program. Exception: The owner
of a single family dwelling shall be allowed to secure a permit to construct,
alter or repair said dwelling provided the following conditions are met: (1) the
homeowner currently occupies the dwelling or will occupy the dwelling once
the construction has been completed; and (2) the homeowner undertakes the
work himself/herself, without compensation and no person shall be employed
to assist the homeowner in any way on such work except a builder or building
contractor licensed by Johnson County. The Building Official may waive the
provisions of this Section where it can be established that no license exists for
the installation, alteration or repair of a certain type of work requiring a permit,
or due to other unique circumstances.
D. Hearing Procedure. At a hearing on a permit application, the ARB shall allow the presentation
of evidence by the applicant for the permit and by any other person determined by the ARB to have any
appropriate interest in the application. At a hearing for any other matters referred to the ARB under these
Zoning Regulations, the ARB shall allow the presentation of evidence by any person determined by the ARB
to have an appropriate interest in the matter. The rules of evidence prevailing in courts of law or equity shall
not be controlling in hearings before the ARB. The ARB may establish a limitation on the time allowed for the
presentation of evidence. In the event that neither the applicant nor a representative acting on behalf of the
applicant requests a continuance or appears at the hearing to present evidence in support of the application on
two occasions, the ARB may, in its sole discretion, deny the application without consideration of the required
findings set forth in Section 5-146.

Section 105.2 of the International Building Code, 2012 Edition, Work Exempt
from Permit, is hereby amended to read as follows:
Building: amend so items 1, 2, 3, 4, 5, 6, 8, 9, 10, 12 and 13, shall be omitted
in full.

Section 105.2.3, Public Service Agencies, shall be omitted in full.
E. Rules. The ARB may establish such other rules of procedure for conduct of hearings and for
consideration and action upon matters presented to the ARB as it shall determine appropriate.
5.
Section 105.5, Expiration, shall be omitted in full.
F. Pre-Application Conference for Substantial Construction Matters. All substantial construction
matters involving a new or replacement Principal Building on a lot shall be presented at a Pre-Application
Conference before the project may be noticed and placed on the agenda for a public hearing before the ARB.
Following the Pre-Application Conference, and in order to expedite consideration of the application, the City
staff may give direction to the applicant to construct story poles, clearly mark building footprints or take other
measures designed to aid in the understanding of the project and its relationship to surrounding properties prior
to the hearing on the application before the ARB.

Sealed bids for 2015 CHIP SEAL PROGRAM – PART 1 (MR-1678) will be received by the City of Overland Park,
Kansas, at the office of the City Clerk, City Hall, 8500 Santa Fe Drive, Overland Park, Kansas 66212 until 2:00
p.m. local time on March 10, 2015. At that time all sealed bids will be transferred to the City Council Chamber,
City Hall, where they will be publicly opened and read aloud. Any bid received after the designated closing time
will be returned unopened.
All bids shall be submitted in sealed envelopes addressed to the City Clerk of Overland Park, Kansas, and
marked “BID FOR: 2015 CHIP SEAL PROGRAM – PART 1 (MR-1678)”. Copies of plans, specifications, bid
documents and other contract documents are on file at the office of the Director of Public Works located at City

Obtaining these documents from any source other than directly from the source listed herein may also result in
failure to receive any addenda, corrections, or other revisions to these documents that may be issued.
Contractors should read and be fully familiar with all contract documents before submitting a bid. In submitting
a bid, the bidder warrants that it has read the contract documents and is fully familiar therewith and that it has
visited the site of the work to fully inform itself as to all existing conditions and limitations and shall include in its
bid a sum to cover the cost of all items of the work.
Should a bidder find “defects” as defined in paragraph GC‑3 of the General Conditions, it shall follow the procedures outlined in paragraph GC‑3 to bring same to the attention of City. Changes necessitated thereby shall be
in the form of addenda issued by the City.
All bidders shall verify that they have considered all written addenda. The City shall not be responsible for oral
instructions.
Any written addenda issued during the time of bidding shall be covered and included in the bid. There will be no
clarifications or exceptions allowed on the bid. Bids are for a total bid package, total contract price.
Bids shall be made upon the form provided in ink or typewritten. Numbers shall be stated both in writing and in
figures; the signature shall be long hand; and the complete form shall be without alteration or erasure. On alternate
items for which a bid is not submitted, a written indication of “no bid” on the bid form is required.
No oral, telegraphic, facsimile or telephonic bids or alterations will be considered.

Each bidder shall file with its bid a bid bond, a cashier’s check or a certified check drawn on any acceptable bank,
made payable to the City of Overland Park, Kansas, in an amount of not less than five percent (5%) of the total bid,
which shall be retained by the City of Overland Park until a contract for the project has been executed. Bid bonds
will be returned to the unsuccessful bidders, with the exception of the second qualifying bidder, at such time as
their bids are rejected. The bid deposit of the successful bidder and the second qualifying bidder will be returned
when satisfactory bonds in an amount equal to 100% of the contract amount, required insurance certificates and
other required documents shall have been furnished and the contract documents have been executed.
In the event the successful bidder is unable to execute the contract, for whatever reason, City may exercise its
legal prerogatives, including, but not limited to, enforcement of its rights as to the bid security.
The City reserves the right to accept or reject any and all bids and to waive any technicalities or irregularities therein.
Bids may be modified or withdrawn by written request of the bidder received in the office of the City Clerk, prior
to the time and date for bid opening; provided, however, that no bidder may withdraw its bid for a period of thirty
(30) days from the date set for the opening thereof. ALL BIDDERS AGREE THAT REJECTION SHALL CREATE NO
LIABILITY ON THE PART OF THE CITY BECAUSE OF SUCH REJECTION. IT IS UNDERSTOOD BY ALL BIDDERS
THAT AN UNSUCCESSFUL BIDDER HAS NO CAUSE OF ACTION AGAINST THE CITY FOR BID PREPARATION
COSTS. THE FILING OF ANY BID IN RESPONSE TO THIS INVITATION SHALL CONSTITUTE AN AGREEMENT
OF THE BIDDER TO THESE CONDITIONS.
