Minutes of the council of the MUNICIPALITY OF MILLE-ISLES Ordinary session of November 3, 2010 Province of Quebec MRC of Argenteuil Municipality of Mille-Isles Minutes of the regular session of the municipal council of Mille-Isles, held on November 3, 2010 at 7 :30 pm. at the regular meeting place, under the presidence of the mayor Mr. Yvon Samson, and those present were the following council members : André Durocher, councillor seat # 1 Daniel Maurice, councillor seat # 4 Michel Nadeau, councillor seat # 3 Michel Mégélas, councillor seat # 5 Noreen Howden, councillor seat # 6 Mrs. Johanne Ringuette, general director and secretary treasurer, was also present and acted as secretary for the session. OPENING OF THE SESSION The quorum being established, the mayor declared the meeting open, and called for a period of reflection The mayor gave a reading on his « Report on the financial situation for 2010 for the Municipality ». QUESTION PERIOD The question period started at 7 :30 pm. CURRENT AFFAIRS 1. Adding to the « Policy of infrastructure construction 2010 » Question Period Closing of the session 2010-11-191 It is motioned by councillor Michel Nadeau, approved by councillor Michel Mégélas and unanimously resolved by the councillors (5) to adopt, as written.the agenda of the present session. UNANIMOUSLY CARRIED. 2. Approval of the minutes Considering that the minutes for the regular session of October 6, 2010 were remitted to the elected officers at least forty eight (48) hours befor the present session; 106 Minutes of the council of the MUNICIPALITY OF MILLE-ISLES Ordinary session of November 3, 2010 Considering that the council members recognize having received and read them. 2010-11-192 It is motioned by councillor Noreen Howden, approved by councillor Michel Nadeau, and unanimously resolved by the councillors (5) to approve the minutes of the regular session of October 6, 2010, as written. UNANIMOUSLY CARRIED. 3. Approval of the accounts Considering that the council members took notice of the list of accounts for October 2010. 2010-11-193 It is motioned by councillor André Durocher, approved by councillor Noreen Howden, and unanimously resolved by the councillors (5) that the accounts listed in the list of accounts for October 2010 totaling $37 552.37, be approved and their payment be authorized. The council recognizes having taken notice of the irreversible expenses for October 2010 and approves their payments UNANIMOUSLY CARRIED. I, the undersigned, in my capacity as secretary treasurer, declare that there are funds available to pay the above mentioned expenses authorized by the council. Deposit of Financial statement The general director and secretary treasurer deposited with the council the two comparative financial statements for revenue and expenses previewed in article 176.4 C.M.Q., which was prepared by the accounting co-ordinator. Filing of the list of persons indebted to the Municipality for taxes The general director and secretary treasurer deposited to the council the list of persons indebted to the municipality for taxes. (art. 1022 C.M.), Correspondence A resume of the correspondence was remitted to each of the council members at least forty eight hours before the present session. The mayor gave a reading for the benefit of those present in the hall. 6. Public Security a) 2010-11-194 Acquisition of equipment – gun deployment It is motioned by councillor André Durocher approved by councillor Michel Mégélas and unanimously resolved by the councillors (5) that the municipality of Mille-Isles authorize the fire chief to proceed with the purchase of a rapid deployment gun for the fire security department, for a sum of $2599. plus taxes from the Arsenal, a supplier of fire equipment. UNANIMOUSLY CARRIED. I, Johanne Ringuette, general director and secretary treasurer, certify that the sum necessary for the authorized expense, resolution # 2010-11-194 is available in the budget post 23-03000-725. b) Program of quick access to properties Considering that certain properties of Mille-Isles are equipped with barriers limiting access to the property by emergency services which increases response time; Considering that the municipality wishes to offer a solution to its citizens in order to decrease the response time for emergency services; Considering that the municipality of Mille-Isles also wishes to minimize its responsibility for the key management; 2010-11-195 It is motioned by councillor Michel Mégélas approved by councillor Noreen Howden and unanimously resolved by the councillors (5) that the municipality of Mille-Isles retain the solution proposed by the company Canada RAM an offer based incentive for citizens of Mille-Isles, the possibility of joining the program for quick access to properties (PARAP). The director of fire services is responsible for the preparation and application of the said program PARAP in order to present it to citizens or association concerned. UNANIMOUSLY CARRIED. 8. Opening of a line of credit for $175 000 with the Caisse Desjardins of Argenteuil Considering that it is necessary to proceed to open a line of credit with the Caisse Desjardins of Argenteuil. 2010-11-196 It is motioned by councillor André Durocher, approved by councillor Noreen general director and secretary treasurer to proceed with the opening of a line of credit for the municipality, in the amount of $175 000 with the Caisse Desjardins of Argenteuil. This follows the migration of all banking operations of the municipality to the Caisse Desjardins of Argenteuil. UNANIMOUSLY CARRIED. 108 Minutes of the council of the MUNICIPALITY OF MILLE-ISLES Ordinary session of November 3, 2010 9. 2010-11-197 Payment to Mario Allard, architect - Municipal building feasibility study It is motioned by councillor Noreen Howden approved by councillor Michel Mégélas and unanimously resolved by the councillors (5) that the municipality of Mille-Isles authorize the payment of the honorary note #1020-01 presented by Mario Allard architect for the feasibility study and rehabilitation of the municipal complex in the amount of $ 8 505.05 (réf : réso. # 2010-04-082). UNANIMOUSLY CARRIED. I, Johanne Ringuette, general director and secretary treasurer, certify that the sum necessary for the authorized expense, resolution # 2010-11-197 is available in the budget post 02-19000-522 after transfer of credits from post 02-47000-444. 10. Final acceptance of the repair of roadway 2009-Chemin Scraire (sector Edwise) Considering the recommendation from Équipe Laurence, council-experts, to release the contract retention of 5% on the work done on Chemin Scraire in 2009; Considering it is necessary, however, that the contracter produces statutory declaration or a discharge from the subcontractor on the record. 2010-11-198 It is motioned by councillor André Durocher, approved by councillor Michel Nadeau and unanimously resolved by the councillors (5) that the municipality of Mille-Isles pay to Asphalte Desjardins inc. the sum of $3 200.37 ,which is detailed in the following chart : I, Johanne Ringuette, general director and secretary treasurer, certify that the sum necessary for the authorized expense, resolution # 2010-11-198 is available in the budget post 55-13600-000. . Provisional acceptance – Work on rehabilitation of roadway 2010 - Asphalte Desjardins inc. Considering the recommendation of Équipe Laurence, council experts, to make the payment for the work done on Chemins Black, Tamaracouta and Scraire; Considering it is necessary, however, that the contracter produces statutory declaration or a discharge from the subcontractor on the record. 2010-11-199 It is motioned by councillor André Durocher, approved by councillor Noreen Howden and unanimously resolved by the council (5) that the municipality of MilleIsles pay to Asphalte Desjardins inc. the sum of $152 598.70, which is detailed in the following table : UNANIMOUSLY CARRIED. I, Johanne Ringuette, general director and secretary treasurer, certify that the sum necessary for the authorized expense, resolution # 2010-11-199 is available in the budget post 23-04000-710. . 12. Programming work – TECQ 2010-2013 Considering that the Municipality of Mille-Isles : Took notice of the Guide for terms of payment of government contributions under the program the gas tax and the contribution of Quebec for the years 2010 to 2013; Must comply with the terms of this guide that apply to it in order to receive the government contribution that has been confirmed in a letter to the Minister of municipal Affairs, of Regions and Land occupancy. 2010-11-200 It is motioned by councillor André Durocher approved by councillor Michel Mégélas and unanimously resolved by the councillors (5) that the municipality of Mille-Isles : agrees to the terms of the guide that apply to them; agrees to be solely responsible and release Canada and Quebec as well as their ministers, officers, employees, and agents from any liability for 110 Minutes of the council of the MUNICIPALITY OF MILLE-ISLES Ordinary session of November 3, 2010 claims, demands, losses, damages and costs of any kind with an injury to a person, the death there of, damage to property or losing property due to deliberate acts or arising directly or indirectly from investments made through the financial assistance received under the program TECQ 20102013; approves the content and allows it to be sent to the Ministry of Municipal Affairs, Regions and Land occupancy of the programming work attached to this and all other documents required by the department to receive the government contributions which was confirmed in a letter to the Minister of Municipal Affairs, Region and Land Occupancy; committed to achieving the minimum capital Municipal infrastructure set at $28 per capita per year, a total of $112 per capita for all four years of the program; undertakes to inform the dept. of Municipal Affairs, Regions and Land Occupancy of any such amendments to the line-up of work approved by this resolution. UNANIMOUSLY CARRIED. 13. 2010-11-201 Adding to the « Policy of infrastructure construction 2010 » It is motioned by councillor Noreen Howden approved by councillor André Durocher and unanimously resolved by the councillors (5) to add to the « Policy of infrastructure construction 2010 » the article 9 concerning the municipalisation of roads, as written : 9. Municipalisation of roads 9.1 The Municipality will consider requests for municipalisation paths when the private road in question meets or will comply with the standards required by this policy. 9.2 To this end the owner of the road must send a document which states he accepts the municipalisation and that he agrees to give up the lot or lots in question for $1.00. 9.3 The requester must submit to the Municipality a request signed by 50% + 1 of the citizens affected by pledging to assume a debit settlement by imposing a special tax to their building with the following charges : a) surveyor’s fees for preparation of the cadastral plan, if necessary, and the costs of issuance of a subdivision permit, the contribution for the parks and other related costs; b) Cost of study and preliminary plans of work to be done and costs incurred; c) Costs for the preparation of plans and specifications for the upgrading of the road as described in this policy, professional fees of the engineering firm to supervise the construction as well as the engineering laboratory commissioned at the completion of the work; d) Costs of keeping a register provided in the procedures for adoption of a loan by law and the holding of a referendum, if any; e) Costs relating to the conveyance of the property, including notary fees. 9.4 Instead of a loan bylaw, the concerned citizens can make the upgrading of the road at their own expense, prior to concluding an agreement in accordance with regulation respecting the agreements on the implementation of municipal works. Closing of the session 2010-11-202 The agenda having been exhausted and no more questions from those present in the hall, at 8 :55 pm. It is motioned by councillor Andre Durocher, approved by councillor Michel Nadeau, and unanimously resolved by the councillors (5) to close the present session. UNANIMOUSLY CARRIED.
