Illinois’ Pyrotechnic Use Act bans the sale, possession, and use of consumer fireworks. For the July 4th weekend, the New Baden Police Department will be responding to firework complaints on a case-by-case basis and will be issuing warnings and, potentially, citations. Residents should exercise caution and their best judgement to celebrate our Nation’s independence safely. 409 E. Hanover Street 618-588-7793 Crosswalks With the extra summer pedestrian activity, motorists are urged to be aware of pedestrians and bicyclists. State law requires that motorists yield to pedestrians in crosswalks. Similarly, pedestrians are encouraged to always be alert and cross streets at the corners or in crosswalks. JULY 2016 Lack of State Budget May Stall Interstate 64 Construction Project In April of 2015, the construction along Interstate 64 at Rieder Road, West of New Baden, began. The project includes a new interchange and widening of the Interstate; and it was supposed to be completed by June of 2017. Highway 161. The interchange may require improved traffic controls and the surface of Highway 161 is deteriorating rapidly. If IDOT determines these improvements are needed, a lack of State funding may hinder or delay this work. However, the State of Illinois legislators did not pass a budget for fiscal year 2016. And now, they might not be able to agree to pass one for fiscal year 2017. This has impacted numerous communities, organizations, school districts, and individuals throughout the state. And recently, IDOT has started informing contractors on their construction projects that, if a budget is not in place by June 30, the end of the State’s fiscal year, that work may have to be suspended. There are stopgap budgets proposed as of the writing of this newsletter, but if this work stoppage occurs, many New Baden residents will have to continue to safely navigate the Interstate Work Zone for a longer time. The lack of a budget, as happened last year, also threatens future Village revenues from sources such as Use Tax, Motor Fuel Tax (for local street maintenance), and Video Gaming. Additionally, the Illinois Department of Transportation (IDOT) purchases water from the Village for the Gateway Rest Area and is now 11 months behind on the water bill. The Village has also been working with IDOT officials to monitor the traffic and roadway conditions at the interchange of Interstate 64 and Information to help motorists be safe on Illinois highways can be obtained from the Illinois Highway Safety Plan at www.ishsp.org. NEW BADEN NEWS PAGE 12 JULY 2016 JULY 2016 PAGE 1 NEW BADEN NEWS Updates on Recent Village Board of Trustee Actions Rezoned Property on Clinton County Line Road At the June 6th, 2016 meeting, the Board of Trustees approved an ordinance changing the zoning classification of recently-annexed property at 700 North Clinton County Line Road from Agricultural (“A”) to Single-Family Residential (“SR-1”). When property is annexed into the Village, it must be annexed as Agricultural. The property owner is seeking to develop Northridge Estates Phase II on the site. Ordinance Establishing Prevailing Wage Rates Each June, the Village is required to pass an ordinance establishing local prevailing wages, as guided by the Illinois Department of Employment Security. Due to the State of Illinois budget crisis, the most recent determination of prevailing wages is from July of 2015. The Board of Trustees approved this ordinance at the June 6th Board meeting. St. George Parish Picnic Also at the June 6th Board meeting, the New Baden Board of Trustees approved three requests related to the St. George Parish Picnic to be held on August 13th. The Board approved the closing of Hickory Street, the issuance of a Class “E” liquor license, and a request for signs to be placed in the Village Park promoting the event. Approval of Motor Fuel Tax Bids Bids for the Village’s street maintenance program were opened at 10:00 a.m. on June 6th and the Trustees approved the low bidders at the Board meeting that evening. The materials, typically referred to as “oil and chip”, are bid separately. The low HFE-150 bid (the “oil”) was from Don Anderson Co., Inc. from Hoffman, IL for the amount of $24,733.80 and the crushed stone aggregate bid (the “chip”) was from Beelman Logistics, LLC from East St. Louis, IL for the amount of $14,220. The oiling for the maintenance program should occur on July 21st and 28th. Residents are urged to watch for signs along the streets to be oiled and to remove their vehicles from the roadway if possible. Police Department Activities At the June 6th meeting, Chief Meinhardt discussed the use of fireworks by residents during this upcoming Independence Day holiday. The recent policy has been for New Baden Police to respond to firework complaints and issues when they become a nuisance. It was the consensus of the Board and the recommendation of the Chief to continue enforcement as the department has done in the past. Residents are urged to use good judgment and celebrate safely. The Chief also delivered some bad news at the Trustee’s meeting. An existing squad car may have a blown motor. The Chief has obtained repair estimates and the low bidder was from Kehrer Chevrolet. The Board approved for the Chief to proceed with the repairs or motor replacement, up to $3,800. The Board also approved to begin advertising for an additional New Baden Police Officer. The shift for which the new officer will be hired is commonly referred to as a “power shift” meaning a flexible time of the day where an additional officer is required. This shift is expected to cover commuting hours and extend into the evening / early morning. The shift requires a Memorandum of Understanding (MOU) with the Village’s Collective Bargaining Unit to adjust the wording of the union contract. The MOU was approved at the subsequent June 20th Board of Trustee’s meeting. EMS Billing Company At the June 6th Board Meeting, Administrator Hemmer and EMS Director Allen Gilbert provided a presentation from third-party billing company Andres Medical Billing (AMB) from Arlington Heights, Illinois. By using AMB, the Village will gain an improved level of health insurance compliance, will adapt to standard coding practices, will see reduced workloads, and may see an increase in collected fees. AMB will charge the Village 6% of all fees collected. While no contract has been approved at this time, the consensus of the Board was in favor of suspending the bidding requirement and reviewing a one-year contract from AMB. North 2nd Street Culvert Bids A contract agreement with Gelly Excavating from Highland, the low bidder, was approved for the North 2nd Street Culvert project in the amount of $254,896. The engineering estimate of probable costs was $340,000. For this month’s business spotlight we spoke with Bernice Pollmann, manager of Southern Mutual Insurance Company. Mutual insurance companies in Illinois have been saving policyholders money for more than a hundred years and were originally formed when farmers had difficulties obtaining insurance coverage for buildings, livestock, homes and machinery. Mutual insurance companies differ from stock insurance companies in that they are operated and controlled by a board of directors who are elected by the policyholders, who own the company. This month, I’d like to build upon an article from last month’s New Baden News about Dogs. (A) It shall be unlawful for any person owning or possessing a dog or cat to permit such dog or cat to go upon any sidewalk, parkway, or private lands or premises without the permission of the owner of such premises and break, bruise, tear up, crush or injure any lawn, flower bed, plant, shrub, tree or garden in any manner whatsoever, or to defecate thereon. (A) Pens, Yards, or Runs. All pens, yards, runs or other structures wherein any animal is kept shall be of such construction so as to be easily cleaned and kept in good repair. The keeping of an unlimited number of dogs is, therefore, declared a public nuisance. The term "dog" shall be construed as provided in Section 3-1-1. 3-1-4 KEEPING BARKING DOGS AND CRYING CATS. (A) Harboring. It shall be unlawful for any person to knowingly keep or harbor any dog which habitually barks, howls or yelps, or any cat which habitually cries or howls to the great discomfort of the peace and quiet of the neighborhood, or in such manner as to materially disturb or annoy persons in the neighborhood who are of ordinary sensibilities. Such dogs and cats are hereby declared to be a public nuisance. (B) Petitions of Complaint. Whenever any person shall complain to the Police Department that a dog which habitually barks, howls or yelps or a cat which habitually cries or howls is being kept by any person in the Village, the Police Department shall notify the owner of said dog or cat that a complaint has been received and that the person should take whatever steps are necessary to alleviate the howling, yelping or crying. 3-1-8 LIMITATION ON NUMBER OF DOGS AND CATS KEPT. (A) Nuisance. The keeping of an unlimited number of dogs and cats in the Village for a considerable period of (2) The provisions of this section shall not apply to any establishment wherein dogs are kept for breeding, sale, sporting purposes or boarding. Except as otherwise provided in this Chapter no person shall keep within the Village any cattle, cows, horses, sheep, swine, goats, chickens, ducks, turkeys, geese, rabbits, or other livestock. (B) Exceptions. This Section shall not apply in areas of the Village that are zoned agricultural in nature nor shall this Section apply to livestock brought in to the Village for the purpose of being shipped out of the Village. (C) Powers of Police Chief. The police chief shall have the power to issue an order prohibiting the keeping of any animal, fowl, or bird which is deemed to pose a health hazard to the general public. Billhartz Civic Center gym will no longer be open on a regular basis. The cafeteria is open from 7:00 - 10:00 am for card playing and social activities. The Center can be used later in the day by contacting Village Hall at 618-588-3813. TUMBLING CLASSES The Park and Recreation Department offers tumbling classes for all ages at the civic center. PARK BOARD MEETINGS The New Baden Park Board meets every 3rd Wednesday, as needed at Village Hall. Meetings begin at 7:00 pm and are open to the public. SOCCER REGISTRATION If you signed-up for fall soccer, coaches will be contacting you in mid-July. Games will begin the week of August 15th. The league will have pre-k (4 years and up)/kindergarten, 1st/2nd grade coed, 3rd/4th grade boys and girls, 5th/6th grade boys and girls, and 7th/8th grade coed divisions. Pre-k/kindergarten games will be played on Saturday mornings from 9-10 am. The other divisions will have games throughout the week and on weekends. JULY FAMILY EVENT Due to a conflict in the park, the July Family Event will be moved to a later date. Follow the New Baden Park and Recreation and Village of New Baden facebook pages for updates. FALL PROGRAMS The Park and Recreation department is working to expand fall programming for tumbling and music classes. Upcoming programs will be during mornings at the O.W. Billhartz Civic Center. The vacant lot at 9 N. 2nd Street, where New Baden previously demolished a residential home, remains for sale. A formal offer was received in December but then withdrawn. The residential lot is in the first block north of Hanover Street. While ideally it would like to recoup as much of those costs as possible, the only restriction on price is that it can not be lower than 80% of the appraised value, or in this case at least $9,600. The Village also expects the buyer to pay all closing costs, so there is no additional cost to taxpayers. This law is called “Scott’s Law” and is named after a Chicago Fire Department Lieutenant that was struck and killed while assisting with a crash. This offense could include imprisonment and a fine of up to $10,000. Illinois Work Zones are in effect 24 hours a day/7 days a week. Workers do not have to be present for a motorist to receive a speeding ticket in a Work Zone. The minimum fine for speeding in a Work Zone is $375 for the first offense and $1,000 for the second offense. If the second offense occurs within two years of the first offense, your license may also be suspended. If a crash in a Work Zone causes a fatality, you may be charged with Reckless Homicide; a class 3 felony. In January, Colton Holtgrave received permission from the Board of Trustees to proceed with the addition on the north side of the pavilion. The wind curtain is made of heavy duty material and is operated by a hand-crank system, when needed. The crank is stored in the kitchen area of the pavilion. The curtain has been in operation since April. Colton developed the idea for the project because he remembered helping his Grandfather tack up some plastic sheeting for a friend’s 60th Birthday Party. A sudden weather change and rain had threatened to stop the party plans. While saving the party, Grandpa noted that he had seen a tarp system at one of the pavilions in Breese. Colton conducted research and modeled the New Baden system after the tarps he reviewed. With the help from his fellow scouts and other volunteers, the wind curtain was installed for $1,100. Colton also raised over $1,500 for the project, with the remaining $400 being donated to the Village Park in the hopes that future curtains will be installed.
