Works at a meeting to be held on Wednesday, the ' 7th. We have good reason to think that thi.s report reiterates the previous position taken 'by the Engineer that the remedy for the lack of water is the metertng of the entire service system. We have, tilerefore, to reoommend in this regard that the Council of the Board of Trade represent strongly to the Mayor and City Council the fact that the mercantile community is very seriously concerned in regard to the very dangerous state which the City is now placed as regards the fire menace owini.r to lack of water,' and are prepared to back .up the City Ceunoil to the limit as regards the installation of meters and any other .steps that may prove feasible to overcome the present situation. Your Committee oensiAera that our citizens' are living in a fool's paradise as owing to the lack of water it only requires certain conditions to result in a large part of the City being destroyed in a general oonflagration. .FTRE ATTAR'; SERVICE Notwithstandng the fire alarm servioo has been out of order for practioally two monthe, no prompt cenC4ition steps are in view to put te service the excuse being given that no funds are available. In view of the :act that the safety of the City depends to a great extent on the good working order of the fire alarm sy3tem, it would appear to your oomiiittee that if there was tiny one thing which woulu warrante the City council in goind to the Executive of the Government and getting a guarantee to wovide legislation to protect them in the expencLiture of the necessary money, eurely the putt:Lng of t!e.e fire alarm system in good, shape is cycle of such matters. FIRE PROOF ACCOLODATIO7 FOR FIRE ALARM CENTRAL. City Audftorities have ilnis matter undet cons der Zion, and apparently had decided on continuing the of te City Hal: whore it fire alarm in the at was damaged by fire some tuo months ago, with the proposed improvement of tin lining the room and making seine as much fire proof as possible. It appears to us that the Council of the Board of Trsde should protest against such a procedure and urge upon the City council that if it is not feasible to have a small fire proof buildjeng constructed to , ake care cf the fire alam central,t al-It a fire - 6 04 1. r ?., Laavaini_laR2_ proof room should be provided at one of the eng:Lae b.ouses or in some other outside building that would not have the same fire hazard as exists at the City Hall. SALTWATER TANKS The ffngineer advised that he ac} nsiderec.L bi.vt the pi'oposed seheme of providing salt water wells or tanks on Water Street quite feasible, and that the m;,tter would have probably had some attention but for the Halifax disaster which upset so many proposed city plans. We would., therefore, recommend at the Council of the Board. of Trade strongly recommend to the City Council a prompt investigation !..dY this scheme and its immediate care 7ing out if the proposals will help out the fire risk situation. Your Committee in onsulting with the City authorities advised them that they oould count oh the hearty co-operation of the merchants the City as represented by the Halifax Board of Trade end that considering the ribk involved and, ari we understand it, the liklihoo of further increases in the rates of insurance, that the Council could rest assured that they would. be fully backed up even in fairly large expenditures that would mean the safe-guarding of property and life. Dear Sir:The Chef of the Fire Department hao obtained for me interviews with t1-1.e witnesses is these claims, and I beg. to report of the same. The claims are :- 1. Running over a line of ?lose on Windsor Street on the 12th of January. 2. Running over a L.ne of hose on Charles Street on the 14th of January. 3. Colliding with a ladder cart on SprinT Garden Road in March last about the tfLme, of the return of the I will deal with these in order. R.C.R. The evidence of the witnesses, especially let. John Ho-Anson, k)seman on the waggon, is that the night in question was fine mad clear, and the liqht on the corner of North and Windsor Streets was burning brightly. When the line of hose was laid aoorss south corner of Windsor Street ,Hoganson went to the streets and did his utmost to warn the driver of the tram oar by standing in the middle of the track hands. The driver, and shouting to him and waiving however, paid no Eltention, but came on to tba (1,)rth side of the s treet running over the line of hose and destroying the, When asked what he meant by so doing he made no anever. It appears to me that there TVELU and. still negligence both in not seeThg f2;reater negliunce in no G paying atbention to so clear a sinal, and that for ti-1:+.s the Company sh()uld be liable. 7 lq January 19 20 2nd. In this case it VMS a dark niftht and. no light at tile oorner, and tne hoseMon on. 7 ayin2.; out the hose had gone to the man in. charge of the engine to ascertain if it was ready to turn on the water. In the meantime the tram car came on aild passed over the hose. The engine was situated on nharles Street past the corner and Could easily have escaped the notice of the driver of the c ar. I CI.0 not t)ink ''GhE,, evidence sufficient in t.Liis case to justify an action for negligence. 3rd., The evidence of the driver of the car and the Deputy Fir3 Chief in this was is that the car was coming dam spria1 - 2; Garden Road at about 12.30 The night was clear anet all lights burning briglltly. At the corer of oueen Street the horses were oomin.1; • slowly and the driver sounded his gong continuously. There was a heavy load - of ladder s on the waggon, gaon Ell y an o ea tin over both sides. In order to let a tram car going east pass on the .norti side= the driver had pulled over to the south side of the road. As soon as the oar had passed he started to return to his proper side* This was nearly at nueen Street. A west bound car was seen coming up the hill at approximately S t. Mary's Cathedral, coming very fast, estd.raated at between twenty—five and ti.t.irty miles an hour.. calLe right on .without slackening speed, and struck the ladder truck at the tind cons itfi.arable damage. Viihen asked what he meant the driver a(1a.iitted that he had never seen ti:le ladder truck: - It is admitted, h,owever, by the persons in charge of the latter waggon, that the wag!zgo. was showing no lights, and this point is expressly taken claiiy,s department of the in the letter of defendant Company The point so taken is nct an easy one to dispose of. It is not clear in the first r Et: :I. ft. t s applies place. whether the refutation to the vehicles of tile Fire Department, and in the sed.ond place whether the absence of lights was a matter which in itself would debar the City from recovering doznages for a collision w:l.thout further iJ abseace was only a matter o: proof, or whether evidence, and that the City' could still recover iit 1,7as clear that the absence of lights was no excuse for the negligence of the driver of the tram oar. If watter were very large it would be worth contesting res— in order oo ascertain exactly what t1).e pectively V/ a ; but in this matter it seems to me that a compromise on the point m:',.ght well be suggested. Assuming accordingly that the facts as Fiven .to me by the officials of the Department are established and are not controverted by opposing evldenoe, it appears 7 Jaauary nh, 1,920 me that the C o mp any is liable for the full anwunt of the damage done on Windsor Street; that it is not liable fox the dazage done on Ohalres Street and that the damage clone to the ladder cart is 1/a matter open to reasonable compromise.
