The Benefits of a Legacy Fund Many donors find their philanthropic wishes can be met by establishing a Legacy Fund through LEAF. Legacy Funds are permanent funds from which only the income is used. The annual investment income, or interest, is used for the purpose designated by the donor. Additional gifts may be made to the fund to increase the principal and thereby increase the annual investment income or as a one-time pass-through donation. Legacy Funds represent rewarding gift opportunities because they offer the donor the satisfaction of knowing that his or her gift will continue working for future generations. How a Legacy Fund is Established The Legacy Fund may be established with a contribution in the form of cash, appreciated securities or other charitable gifts such as a bequest. The fund is invested by LEAF, which serves as a steward of the Legacy Funds. The Foundation is a nonprofit, 501(c)(3) organization. Contributions to LEAF are taxdeductible as allowable by law. The Purposes of a Legacy Fund With the assistance of LEAF, donors can specify the details of the fund’s objectives. The following ideas are a sampling of what a Legacy Fund can accomplish to enhance educational excellence. Income from Legacy Funds will enable LEAF to support undergraduate scholarships, graduate student fellow-ships, professorships, chairs and promising research. Funds range from $5,000 to any amount established by the donor: • An annual student scholarship to financially assist those students attending a particular program • A multi-year award for distinguished students • Provide funds for faculty development to aid the scholarly, professional and personal growth of horticultural faculty at the educational facility of the donor's choice • Create a faculty recognition award to acknowledge the contributions of an outstanding faculty member at any institution • Establish a fund for a distinguished visiting scholar that finances the annual cost of a visiting scholar in an academic field • A fund to support a specific campus, academic department, program, equipment or service • Create a fund to support an annual conference or lecture series • A fund to provide additional resources for horticultural libraries EQUIPMENT FOR SALE! Jerry Brown last month signed a measure clarifying that “consultants” who provide certain construction management services for the home improvement market are contractors and therefore must be licensed. CLCA supported this legislation, Assembly Bill 2237, which was authored by Assemblymember Bill Monning (D-Santa Cruz) and sponsored by the Contractors State License Board. Previous law defined a contractor to include a “consultant” who offered to construct a building or home improvement project. However, in 2009 an appellate court decision found that someone overseeing a contract between a project owner and a contractor was not required to be licensed as a contractor. Then, more recently, an unlicensed contractor facing criminal prosecution for engaging in the business of a contractor without a license claimed to be a project coordinator. Even though this contractor was not overseeing a contract between an owner and a licensed contractor, the defense strategy resulted in a plea bargain that dismissed the charge for contracting without a license. The CSLB sponsored AB 2237 to protect the public from persons presenting themselves as “consultants,” but actually acting in the capacity of a contractor by scheduling subcontractors and exercising responsibility for the construction project. Specifically, the new law clarifies that “consultants” are individuals other than public agencies or owners who provide or oversee a bid for a home improvement construction project or who arrange for and set up work schedules for contractors and subcontractors and maintain oversight of a home improvement construction project. AB 2237 goes into effect on January 1, 2013. ~ Larry Rohlfes Alternative Workweek Scheduling Information On CLCA Website C LCA members may access a fact sheet from the California Employers Association on how to establish an alternative workweek schedule. Simply visit the Knowledge Bank on the CLCA website after logging in as a member, select the documents in the Human Resources Management category, and look for the following: Alternative Workweek Schedules: California Employers Coalition Fact Sheet. Alternative workweek scheduling allows non-exempt employees to work more than eight hours per day without requiring the payment of daily overtime. Implementation requires a vote of all employees in a work unit after proper disclosure and procedures set forth in law. An Exciting New Central Coast Invention: Western Weeping Olive™ “Fruitless!” Tree T he Western Weeping Olive™ “Fruitless!” Tree, developed on the Central Coast, has been US Patent Approved. There are over 800 million olive trees currently growing in the world and now one unique tree from San Luis Obispo County is available. The Western Weeping Olive™ “Fruitless!” Tree was invented and developed in the beautiful and historic Santa Margarita Ranch Area. According to the inventor, Blair Shurtleff, there has not been a new olive tree to come along that has all of the great qualities of olives such as drought tolerant, multi or single trunk, beautiful bark, able to withstand temperatures of extreme highs (100-120) and periods of low teens. The Inventor Shurtleff, a horticulturalist and the inventor of this phenomenal weeping olive was a California Polytechnic State University (San Luis Obispo), Ornamental Horticulture/Fruit Science major in the 70’s and is a long time resident of SLO County. “I have collected trees from all over the world and I set out to find something different,” said Shurtleff. “Unique plants have always been my passion and this invention of the Western Weeping Olive™ “Fruitless” will change the olive tree landscape market. Shurtleff has spent 18 years growing this tree, putting it through 6 formal years of rigorous testing in a licensed and secure testing facility, used one of the finest plant patent attorneys, John Peck, KPPB, of Newport Beach California. Typically, trial periods for plant patents usually only last 2-3 years. It weeps: Long, flexible weeping habit with 6’ (when mature) weeping structure. It cascades. The branches shoot straight up then after a few months turn and grow down. “I have spent years online researching every olive tree, olive tree nurseries, worldwide Plant Breeding and Patent offices to guarantee that there is no other olive tree like this in the world,” said Shurtleff. “This is the first new ornamental olive tree patent to come along in over 20 years and it was developed right here on the Central Coast.” Why Is This New Olive Tree The Most Exciting Tree To Next to no leaf drop: Very few leaves ever drop from this tree. There is next to no clean up. This is also excellent for landscape plants in fire prone areas. The leaf color: The Western Weeping Olive Tree leaf has a deep, dark green and SMOOTH top side with the soft grey ‘olive color’ underside. It will shimmer in the wind. The leaf size: Over twice the leaf size of all other olive trees. Fruitless: All of the Western Weeping Olive Trees set no olives but a rare few set some ‘shot berries,’ a very immature fruit that never matures or drops on the ground, dry, so no hazards or mess! This is the only fruitless olive under patent in the world. the Western Weeping completely alone but on some consumed some leaves or few leaf tips never to touch again. These trees were tested in extreme deer conditions. Care: The olive requires little care and can be left natural for life. It can be pruned and shaped for patio trees or can be laced to enhance the weeping characteristics. Needs little fertilizer and always has its rich, dark green leaves, with beautiful olive color undersides. Grows in the same soil mix as all other olives. Grows in zones 8-11. For more information about the tree, contact Blair Shurtleff at 805.602.7321 or getblair@ mac.com or visit http://theweepingolive.com/. High wind resistant: Tested in 70-80 mph winds with no leaf loss, no branches broken and little leaf tear. Deer resistant: These trees were tested with and against five other varieties of olives and scored number one in deer resistance. The Rain Bird Factory Trained Program is designed to help contractors build their skills and open up new opportunities. “Contractors who participate in our Factory Trained Program receive high-level and in-depth training on central control system features and installation best practices,” said Robert Pfeil, services marketing group manager for Rain Bird Services Corporation. “They also receive from page 12 a valuable designation that they can use to market their expertise. In return, designers and end users can rest assured that when they hire a graduate of our Factory Trained Program, the job will be done right.” The courses in the Factory Trained Program feature practical, hands-on training exercises to reinforce information learned in the classroom. After completing a course, students take an exam to test key knowledge areas. Designations are awarded to individuals who pass the exam. The Factory Trained Program offers professionals a chance to earn Installer, Operator and Technician designations across the complete line of Rain Bird Central Control products for commercial and golf applications. “Designers and commercial property owners look for professional contractors who can keep projects on schedule, properly install systems and keep systems running efficiently,” said Pfeil. “We designed this training program to give contractors the necessary tools and knowledge they need to do all these tasks with confidence.” The Factory Trained Central Control Installer course teaches students how to install the appropriate hardware components and select the right communications configuration for the site. The Factory Trained Operator courses instruct professional contractors, superintendents or water managers on the powerful features of Rain Bird Central Control products and how those features can help them efficiently manage system and water resources. The Factory Trained Technician courses hone the skills of maintenance professionals who are in charge of maintaining a Rain Bird Central Control system, enabling them to diagnose system problems quickly and easily. “We designed the Factory Trained courses to work together – allowing professionals to earn multiple designations, and ultimately to develop the skills and expertise to offer their customers a complete central control services package,” Pfeil explained. “This program allows professional contractors to get the expert knowledge they need to successfully expand their service offering and grow their businesses.” The Factory Trained Program will be launching residential and additional golf product courses and designations in 2013.
