Last month I said some things that may not have been clear or may have caused some misinterpretation regarding representation of the COC. I had stated that Steve Puccio was a Rep for the COC. I had gotten that information from one of his emails, but I had failed to verify it. Upon investigation it was discovered that there are more than one organization in Washington State that use the same acronym. One is the Confederation of Clubs, which is part of NCOM and is working with ABATE on many political issues. The other is Coalition of Clubs which is made up of several motorcycle riding clubs and organizations. They are not associated with ABATE or the Confederation of Clubs. If this seems confusing to you, I understand, because it is confusing to me as well. I apologize for any misunderstandings that resulted from my failure to confirm the facts and I hope this clears things up. For the record, Steve Puccio has resigned from ABATE and may be the Rep for the Coalition of Clubs, but that is still unconfirmed. He is part of the “Legislative Assault Committee” which has no affiliation with ABATE of Washington, and he does not speak for ABATE of Washington. That being said, it is very important for every motorcyclist to attend Black Thursday on January 17th. ABATE is taking two issues to the Capitol: the Red Light issue and the Helmet Repeal/Modification bill. Both issues have a lot of support, but we need your presence to make our voice strong. There is also a Meet and Greet Wednesday evening at the Govenor Hotel as well as a Legislative Reception Thursday afternoon starting at 4:00 PM. There is more information about these events on page 17 and 18. Please come and meet everyone. It will be informal and you can talk to anyone you want. It’s good to get to know your legislators and it’s good for them to know you, too. Don’t forget to have your Chapter LAO or Chapter Coordinator (if you have no LAO) make the appointments for Black Thursday. It’s easy, and you only have to talk to their aide. They make the appointments. It’s not as scary as you may think, and making the appointment will set aside the time you need to have that all important face time to discuss the issues. Then, after the session is over, go visit your legislators in your district when they have more time. It will give you a chance to find out what they think about many issues, and what you can do to help them achieve their goals. A little help from you will go a long way toward establishing a relationship between you and your legislators. That relationship will help ABATE of Washington maintain your freedom of the road as well as get back some freedoms that have been taken away already. I cannot tell you how important this is. If you enjoy riding motorcycles, this is a “must do.” When you get to know your legislators, they will have a tendency to listen to what you have to say. If every ABATE member does this, then we will have the ear of every legislator, and ABATE of Washington will, indeed, be the “voice of the people” and will be heard on the hill. Get involved! Speaking to your legislators should not be a once a year thing; you can do this year round on an individual basis. Hello Everyone, Well I hope everyone enjoyed their holiday season doing the toy runs, food drives, and all activities that come with the holiday season. One of the first things I wanted to do is to thank and apologize to the Olympia Toy Run Coalition. First I want to thank you for allowing us to sell our raffle tickets at your event. I also want to apologize for the way things were handled by some members of ABATE, as that is not the way ABATE of Washington should handle situations that may arise. Well as many of you know we now have our gambling license and we are selling raffle tickets for the motorcycle. We already have tickets with members in different areas and are sending the even more to members as I am writing this. With the gambling license the chapters can now legally do raffles however there are rules and regulations that have to be followed. I will be sending out information on what you can do and what you cannot do and what paperwork has to be done to do this, your chapter should be receiving all the necessary paperwork shortly. This year is a very important month for us as Black Thursday is when we go to Olympia as January 2013 Page 10 G–Man, our communications person, has sent out some communications. If you have not received these it means we do not have your correct e-mail address. When you fill out your applications make sure you print clearly so we can get the correct information. If you have not received these get with your chapter membership person or contact the state membership person to submit the correct information.. Dazzelin’ Dave is already working on the Shakin’ the winter blues party for spring. If you came last year you know how much fun it was. I will post more info on the party as it comes in. We would like to welcome our new legislative officer Randy Gossard as well as our new public relations officer Tanya to our flock. Good to have new blood in some of the positions this year. Well other then watching it rain (but not as much as Randy as he has a new Road King) I don’t have much more to report this month. On a side note all of you who know are are familiar with Ron Hanson or AKA “Side road Ron” he is in the hospital with complications from a bleeding ulcer. Send him a prayer if you can. Black Thursday is next and Rats will be supporting the seminar put on by Donnie Breeze on January 6th at the Poodle Dog in Fife from 9-5. At the October BOD meeting, the legislative agenda was selected to have 2 primary issues: • Providing legislative relief for malfunctioning signals and; • Helmet law modification/repeal. MALFUNCTIONING RED-LIGHTS There are a lot of traffic signals that will not activate with a motorcycle. We need to have an immediate remedy available when stuck at a malfunctioning signal. Making a bigger effort to get relief through legislation will not only reduce our aggravation on the road, but also serves to establish respect of our legislators and government agencies. Ironically, Washington State was the first to offer up this type of legislation. Idaho used the very language found in the original Washington bill and passed it into law 6 weeks from introduction. To date, approximately 13 States have created law that allows motorcyclist to proceed through lights that do not detect their presence. There has been no data that suggests any type of negative impact from this type of legislation. What this all comes down to is an increase in the respect level of the government for bikers in general. Let’s make the effort to help ourselves and possibly get more help us on things we need. Report malfunctioning lights to legislative1@abate-wa.org HELMET LAW MODIFICATION/REPEAL Earlier this year, Michigan legislators passed legislation to allow Freedom of Choice, thus becoming the 31st State to have some level of helmetless travel. The helmet issue has been in question in Washington State for 20 years. ABATE has stayed to the task to bring the issue forward in every legislative session since the mandatory helmet law was put in place. January 2013 Page 22 No matter the method that we have employed, the choice has not been restored to the Washington State motorcycle community. At best, the law is based upon theories and disputable statistics. At worst, the law has been found to be unconstitutional vague. The ongoing infringement on 14th Amendment, and by extension, Article 1, section 7 of the Washington State Constitution should be enough for legislators to remove the mandatory requirement. We all need to take time to familiarize ourselves on all of the issues having to do with the helmet law, and we need to all be on the same page when speaking with our legislators. A good tool to accomplish the first part is to read and memorize the issues that are in the 2013 BLACK THURSDAY PRIMER PACKET. Another good method to understanding why we want to Repeal the helmet law is to attend the upcoming LEGISLATIVE PREPARATION SESSION-HELMET REPEAL (will be January 6th, at the Poodle Dog in Fife, WA). See the Black Thursday Calendar for more information. Once you know why the helmet law needs to be repealed, you will be empowered to educate your legislators how and why they need to vote! SHARROWS; Forcing Traffic Violations I received the following letter from a non-ABATE member. I think it is a true issue as it is another of those laws that is in place that make the law abiding citizen into a law breaker. The letter is correct in pointing out that RCW 46.61.608(2) does not allow for motorcyclist to overtake another vehicle in the same lane of travel. As you can see from the attached picture, these so called ‘Sharrow’ lanes are actually part of the lane of travel and not separated. Since the center lane is not a passing lane, the law abiding citizen could be trapped behind a bicycle just as we are at malfunctioning lights. This letter is a great example of a citizen who has taken time to do his own research, has presented the issue in an understandable manner and has offered a solution to the problem. I have redacted portions of the letter for privacy reasons. RCW 46.04.670 – Operating motorcycles on roadways laned for traffic (2) The operator of a motorcycle shall not overtake and pass in the same lane occupied by the vehicle being overtaken. I did further research and found that the following RCW 46.04.670 confirms that bicycles are indeed considered vehicles, and for the purposes of the entirety of RCW 46.61, Golf Carts are also. RCW 46.04.670 - Vehicle. “Vehicle” includes every device capable of being moved upon a public highway and in, upon, or by which any persons or property is or may be transported or drawn upon a public highway, including bicycles. “Vehicle” does not include power wheelchairs or devices other than bicycles moved by human or animal power or used exclusively upon stationary rails or tracks. Mopeds are not considered vehicles or motor vehicles for the purposes of chapter 46.70 RCW. Bicycles are not considered vehicles for the purposes of chapter 46.12, 46.16A, or 46.70 RCW or RCW 82.12.045. Electric personal assistive mobility devices are not considered vehicles or motor vehicles for the purposes of chapter 46.12, 46.16A, 46.29, 46.37, or 46.70 RCW. A golf cart is not considered a vehicle, except for the purposes of chapter 46.61 RCW. This name of the person who sent this email has been removed. As I ride around the Puget Sound, I started noticing more and more of these “sharrows” popping up on roads. They piqued my curiosity. What was the premise of them? …but as I read the laws that permit vehicles to overtake bicycles travelling on roadways (RCW 46.61.110), we, motorcyclists, are bound to RCWs that do not allow us the same benefits afforded to cars, pick-ups, buses and trucks. We have to remind ourselves of the pleasantries associated with RCW 46.61.608(2). A motorcycle, when driven on a road lined for traffic is not permitted to overtake a vehicle travelling in the same lane. In many streets through the urban area, where on-street parking is permitted, you have a “fat” lane. Bicyclists hug the right side of the road, but if I’m riding a two lane street, legally, I’m not allowed to pass if I’m presented a double yellow line. However, a Metro bus can per RCW 46.61.110. To me, it felt like there was a little glitch that needed correcting inside the RCWs. I confronted the City of Seattle which had been melting these (that’s how they are installed) at various locations throughout the City, and I became alarmed with a municipality installing traffic control features advocating law breaking. …motorcycles overtaking bicycles in the same lane. While no sane cop should pull someone over for such actions, you and I both have been pulled over for just riding a motorcycle. The City, in its response to me, pushed the complaint to WSDOT, which doesn’t install “sharrows.” I brought the issue up to the WSDOT “bicycle and pedestrian coordinator/policy” person. He hushed my complaint by stating that a motorcyclist should simply change lanes to overtake a bicyclist. Do most cars change lanes to pass a bicycle? At most they straddle the line! In a recent [redacte] bulletin, an image shows crews installing sharrows on a stretch of [roadway]…where a double line is present. Because my issue is now falling on deaf ears [redacted], I’m coming to you with a request. I would like see an amendment to RCW 46.61.608(2) permitting an exception to motorcyclists wishing to overtake bicycles in the same lane.While I don’t think this is not nearly as important as the signal detection issue, I do feel that this is an issue that needs to get addressed. Chapter reports must be submitted by the Chapter Coordinator, Deputy Coordinator or a person authorized by the Chapter Coordinator in writing. Chapter announcements and flyers are free with the following restrictions: Chapters are limited to one full page ad per month If the event is during the first week of the month, then a full page ad is allowed in the previous month’s issue. If the event is not in the first week of the month, the full page ad is limited to the issue published in the month of the event. Chapters may place ¼ page ads for up to two months prior to the event except for the issue that the full page ad is inserted.
