Notice of Preparation of Amendment
Amendment C52
Authorisation AO2690
The Rural City of Wangaratta Council has
prepared Amendment C52 to the Wangaratta
Planning Scheme.
In accordance with section 8A(3) of the
Planning and Environment Act 1987, the
Minister for Planning authorised the Rural City
of Wangaratta Council as planning authority to
prepare the amendment.
The Amendment applies to all flood affected
land currently covered by the Land Subject to
Inundation Overlay (LSIO) and/or the Floodway
Overlay (FO) within the Municipality of
Wangaratta. The Amendment also affects land
within the Ovens River rural floodplain area.
The amendment proposes to amend
the schedules to the LSIO and FO in the
Wangaratta Planning Scheme by introducing a
set of building and works permit exemptions,
which will apply to all flood affected land within
the municipality. These exemptions will remove
the need for planning permits for buildings and
works listed in the schedules.
The amendment also includes reference to
the recommendations and findings of the
Flood Study and Preparation of a Floodplain
Management Plan for the Ovens Floodplain
between Whorouly and Wangaratta Report July
2003 (Ovens Floodplain Management Report)
in Clause 21.10 and includes the Ovens
Floodplain Management Report as a reference
document in the Wangaratta Planning Scheme
at Clause 21.12.

Any person who may be affected by the
amendment may make a submission to the
planning authority. Submissions must be made
in writing giving the submitter’s name and
contact address, clearly stating the grounds
on which the Amendment is supported or
opposed and indicating what changes (if any)
the submitter wishes to make.
Name and contact details of submitters are
required for Council to consider submissions
and to notify such persons of the opportunity
to attend Council meetings and any public
hearing held to consider submissions. In
accordance with the Planning and Environment
Act 1987, Council must make available for
inspection a copy of any submissions made.
The closing date for submissions is 21
February 2014. A submission must be sent to
the Rural City of Wangaratta Council, PO Box
238, Wangaratta, Victoria 3676.
Notice of Decision Under Section 16
In accordance with section 16 of the Flora and Fauna Guarantee Act 1988,
Ryan Smith, Minister for Environment and Climate Change, and Peter Walsh,
Minister for Agriculture and Food Security, have:
i. considered the recommendations of the Scientific Advisory Committee as
advertised in the ‘Herald Sun’, ‘Wangaratta Chronicle’ and ‘Snowy River Mail’
newspapers on 20 November 2013 and ‘Weekly Times’ on 27 November
2013, and in the Government Gazette on 21 November 2013; and
ii. considered the comments of the Victorian Catchment Management
Council; and
iii. decided to recommend to the Governor in Council that the taxa
described in the Schedule to this Notice be added to the Threatened List
for the reasons shown in the Table contained in this Notice.

eligibility criteria specified in Schedule 1 of the Flora and Fauna Guarantee
Regulations 2011.
