OF DOCUMENTS TO BE PRINTED
FILE NAME:
In the 1st part the abbreviation of the newspaper’s
name must be written as follows: STP=Sonntag Aktuell.
The 2nd part includes day and month of publication
(DDMM). The 3rd part is composed by the name of the
advertiser.
EXAMPLE:
The files for an advertisement in the Sonntag Aktuell
for 20th January must be saved in a folder/index called
“STP2001 Muster” (max. 24 characters)
INFORMATION FILE: For each PDF/EPS-File a separate text file (info-file)
must be made as follows:

additional colours)
PDF/EPS-FILE:
Please, transmit your advertisement data exclusively
as PDF or EPS-File with included/enclosed writs. The
full-scale advertisement must be surrounded by a
white space of minimum 10 mm and cannot include
such data as date of publication, name of the advertiser,
etc. Please, send us these relative information as a single
document, in a separate info-file.
Advises with a format defined by a surrounding white
space must be obligatorily sent with the trimming
signs generated by the layout program use. Do not use
manually generated trimming signs!
If unwanted print results were caused by a customer’s divergence from the publishers’
suggestions due to the production and the transmission of the documents to be
printed, there will be no reduction of price. Minimal deviations from the desired colour
cannot be seen as a reason for claim reimbursements or price reductions. Prior to
transmitting a document, the customer must make sure that his transmission is not
infected with any virus. If the publisher discovers a file containing a virus, it will delete
the file without opening it before and the customer cannot assert any claims. If the
customer is responsible for some computer virus infiltration, the publisher reserves
the right to claim damages from the customer.
Independently from the digital print documents, a written placing of orders
with file name and reference is necessary. In the case of colour-advertisements, a copy is necessary for each colour.

GENERAL TERMS
AND CONDITIONS FOR ADVERTISEMENTS AND FOREIGN FLYERS IN NEWSPAPERS AND MAGAZINES
1. “Advertisement order” in the sense of the following General
Terms and Conditions is the contract to publish one or several
advertisements of an advertising agency or other advertiser in
printed matter for the purpose of dissemination.
2. In case of doubt advertisements are to be called up for publication within one year after concluding the contract. If the right to
call up individual advertisements has been agreed on in the scope
of a sales contract, the order has to be completed within one year
from publication of the first advertisement, provided this first advertisement is called up and published within the period drawn up
in sentence one.
3. The customer is entitled to call up further advertisements,
even in excess to the number mentioned in the order within the
agreed upon period, i.e. in the period drawn up under Point 2.
The advertisements taken out via NBRZ are not considered in the
granting of discounts procedure of the publishers.
4. If an order is not fulfilled for reasons which the publisher does
not bear the responsibility, the customer, irrespective of further
legal obligations, has to compensate the difference between the
discount
granted and the actually deducted discount to the publisher for
the a published advertisements. Compensation is not due if nonfulfillment is due to force majeure within the publishers risk area.
5. When calculating the quantities purchased, text millimetre
lines are converted corresponding to the price into the ad millimetres.
6. Orders for advertisements and foreign flyers, which avowedly
are to be exclusively published in certain issues, certain copies or
at certain places within the printed matter have to be received in
such time by the publishers to allow the customer to be informed
before closing date should the order not be executable as transmitted. Rubricated advertisements are printed in the respective
category without requiring an express agreement.
7. Text advertisements are advertisements which do not share
at least three sides with other advertisements. Advertisements,
which due to their layout cannot be recognised as advertisements,
are clearly identified as such by the publishers with the word “Advertisement”.
8. The publisher reserves the right to reject advertisement orders
according to the uniform, objective justification principles of the
publishing company – also individual call ups in the scope of quantity contracts and insert flyer contracts - should the contents, their
origin or technical form violate the law or official regulations or
should the publication thereof be unacceptable for the publisher.
This also applies to orders which are concluded with branches,
agencies or representatives. Orders for the insertion of flyers are
only binding for the publishers after receipt of a sample flyer and
their authorisation thereof. Flyers which impart the impression to
the reader by format or layout that they are an integral part of the
newspaper or the magazine or contain foreign advertisements,
are not accepted.
9. The customer is responsible for on time delivery of the advertisement text and perfect print documents or of the flyer. The
publisher immediately demands replacement for print documents
visibly unsuitable or damaged. The publisher assures that the
customary printing quality within the scope of possibilities given
considering the print documents will be provided for the issues
reserved.
10. The customer is entitled to a price reduction or a perfect replacement advertisement for an entirely or partially illegible, incorrect or incomplete copy of the advertisement. The reduction,
however, is only to the extent at which the purpose of the advertisement was impaired. If the publisher allows the period set
for reparation lapse, or if the replacement advertisement is once
again not perfect, the customer is entitled to a price reduction
or a cancellation of the order. Claims for damages arising from
positive breach of demand, default upon contract conclusion and
impermissible action are – even for orders granted on the phone
– excluded. Claims for damages arising from the impossibility to
perform and from delay are limited to the compensation for the
foreseeable damage and the sum due for the advertisement or
flyer concerned. The latter does not apply to malice and gross
negligence of the publisher, of his legal representative and of his vicarious agent. The liability of the publisher for damages due to the
lack of guaranteed properties remains unaffected. In commercial
business the publisher does not bear the liability for gross negligence of vicarious agents. In the other cases where businessmen
are concerned, the liability for gross negligence is limited to the
foreseeable damage and up to the amount due for the respective
advertisement. Complaints must – except in the case of non-visible
discrepancies – be enforced within four weeks after receipt of the
invoice.
11. Drafts are only supplied upon express request. The customer
bears the responsibility for the correctness of the returned drafts.
The publisher copes with all the proof reading corrections that are
imparted within the period set for the transmission of said drafts.
12. If the publisher is not given any particular size, the calculation is
based on the printing height common and standard for the type of
advertisement concerned.
13. Should the customer not pay in advance, the invoice is sent immediately, if possible however a fortnight after the advertisement is
published. The invoice is due for payment within the period, beginning upon receipt of the invoice, as drawn up in the price list – provided no other terms of payment or payment in advance have been
agreed upon. Possible discounts for early payment are granted as
drawn up in the price list.
14. Where payment is in default or deferred, interest at the rate
of 8 percent above the base lending rate and collection costs is
added. Where payment is in default, the publisher may withhold
further current orders until payment has been received and demand payment in advance for the remaining advertisements. Upon
justified doubt concerning the customer’s ability to pay, the pub-
lisher is entitled, even in the course of an advertisement contract,
to subject the publication of further advertisements to payment in
advance and the settlement of invoices still due without taking the
originally agreed upon terms of payment into account.
15. The publisher supplies a copy of the advertisement with the
invoice upon request. Depending on type and complexity of the
advertisement order, clippings of the advertisement, pages of the
issue or complete copies of the publication are supplied. If a copy
cannot be obtained any more, a legally binding assurance of the
publisher is provided with regard to publication and dissemination
of the advertisement.
16. Costs for making ordered photocopies, proofs and drawings
and, not least, for the amendments requested by the customer or
justified essential amendments to the originally agreed upon layout
are borne by the customer.
17. A reduction of price may be derived from reduced circulation
rates for a contract for several advertisements if, seen on the overall average, the average circulation beginning with the first advertisement of the insertion year, is de facto less than the average
circulation drawn up in the price list – or - if circulation is not mentioned – the average sold numbers of the previous calendar year
are undershot (in the case of specialist magazines the average de
facto sold copies ). A circulation reduction only leads to a price
reduction if the discrepancy is:
20 % for a circulation of up to 50 000 copies
15 % for a circulation of up to 100 000 copies
10 % for a circulation of up to 500 000 copies
5 % for a circulation of over 500 000 copies
Further price reductions for contracts are excluded if the publisher
informed the customer of the reduced circulation in such good
time, that the customer could have cancelled the contract for the
advertisement before publication.
18. For box number advertisements the publisher handles the
safekeeping and timely forwarding of the offers with the due care
of a prudent businessman. Registered mail and express mail addressed to box numbers are forwarded as standard mail. The box
number receipts are kept for four weeks. Letters that are not collected within this period are destroyed. Valuable documents are
returned by the publisher without the latter being compelled to
do so. The publisher may be entitled, by individual agreement, to
open the incoming offers in the name and interest of the customer.
Letters that exceed the permissible format DIN A4 (weight up to
50 grams) and goods, books, catalogues and small parcels are
excluded from the forwarding process and are not accepted. The
acceptance and forwarding can, however, be agreed upon as exception should the customer bear the costs.
19. Print documents are only sent back to the customer upon special request. A storage obligation lapses three months after expiry
of the agreement.
20. The place of performance of the contract is the registered office of the publisher. Venue is the registered office of the publisher.
Provided the demands of the publisher are not involved in performance proceedings, the venue is determined by the domicile
of non-traders. If the domicile or residence of the customer is unknown at the time of legal action, or if the customer has moved the
residence or domicile out of the territory of the law, the registered
office of the publisher is the venue.
ADDITIONAL TERMS AND CONDITIONS
a) The publishers bear no liability for the correctness of the reproduction regarding mistakes arising from unclear writing or from
advertisements ordered by telephone or orders for changes made
by telephone.
b) The publishers apply the due care as required by business when
accepting and controlling the advertisement texts, however, bear
no liability if they are misguided or deceived by customers.
c) If the prices for advertisements and flyers change, these new
conditions are enforced immediately, even in the course of existing contracts.
d) The advertiser is entitled to the respective discount due for
booking advertisements for a one-year period if said customer
concluded a contract at the beginning of the period for which a
discount entitlement was agreed on. Demands for retrospective
compensation lapse if they are not asserted within three months
after expiry of the contract year.
e) Corporate discounts are only granted to pooled organisations
of private business. They are not brought to bear for the pooling
of different, independent sovereign organisations or for pools in
which public corporations are involved.
f) Advertisements from trade, handcraft and industry are, as a rule
accepted via advertisement agents who receive their respective
commission. The agent is only entitled to a commission if he himself
rules everything involved in concluding an advertisement order.
Should the agent or his customer, the advertiser, diverge from this
principle, even in only an isolated case, the commission entitlement
of the agent no longer applies to such “direct dispositions”. Only
such AE agencies receive a commission as collect advertisements
commercially in their own name and for their own account and sell
these to third parties. Agencies have to adhere to the list prices of
the publisher and are bound to their customers by contracts and
agreements. The AE commission granted by the publisher may not
be passed on to their customers, neither as a whole nor in part.
g) If there is a large quantity contract of an individual customer, the
discount conditions also apply to the advertisement contracts that
are taken out by the advertising agent. Commission or discount
debits are drawn up for the advertising agent for such contracts.
h) Special terms and conditions acc. to standardised guidelines are
possible for contracts for over 300 000 mm and more and for advertisement sequences of at least 3 consecutive pages in one issue
and for promotion pages.
i) Any fulfilment obligation for contracts and for the performance
of damages lapses in case of force majeur; the same applies in this
context to advertisement that have not been published or not in
time.
j) The customer is alone responsible for the contents and the legal
permissibility of the text and image documents placed at disposal
for insertion. It is incumbent upon the customer to release the pub-
lishers from any possible demands of third parties which arise from
the execution of the order, even should the latter have been cancelled. The publishers are not committed to check the orders and
advertisements in such respect, i.e. whether they violate the rights
of third parties. By granting an advertisement order the advertiser
is committed to bear the costs for a counter statement which refers
to the actual assertions of the advertisement published, and indeed
as per the guideline of the respectively applicable charge for advertisements. If cancelled advertisements are published, the customer
is not entitled to any compensation from the publisher.
k) The contract data of every customer is processed in a computer
system and due to the statutory retention period is stored even
beyond the period of contract fulfilment.
l) Only cashiers fitted with identity cards are entitled to handle
collection.
m) The publisher is not committed to forward number box letters
received from computer services, number box services and commercial correspondence typing pools.
n) Under contracts for insertation of flyers it is possible that for
technical reasons faulty distribution, multiple or faulty enclosures
may occur. The condition and the type of inserts may have an influence on the fault rate. A volume of faulty distribution, multiple or
faulty enclosures up to 2% of the number of inserts contracted for
is deemed to constitute proper contract performance.
