PERMISSION TO APPLY FOR TRANSPORTATION ALTERNATIVE PROGRAM (TAP) GRANT FUNDING THROUGH THE FLORIDA DEPARTMENT OF TRANSPORTATION(FDOT) FOR THE DIXIE HIGHWAY SIDEWALK EXTENSION (WRIGHT BLVD TO GREEN RIVER PARKWAY) PROJECT The City has requested that the County utilize its Local Agency Program (LAP) certification and eligibility to participate in the FDOT’s Transportation Enhancement Program (TAP) for the Dixie Highway Sidewalk Extension Project and will contract for construction of the Project on the City’s behalf. Upon FDOT funding approval, the County and City of Stuart will execute an Interlocal Agreement for the Project. Requestor – Engineering Department on behalf of the City of Stuart Granting Agency – Florida Department of Transportation (FDOT) Project Description – This project consists of the construction of an 8’ wide sidewalk along the westerly right-of-way of NW Dixie Highway from the north terminus of the sidewalk constructed with the Wright Boulevard turn lane project to the southerly terminus of the sidewalk completed with the County’s Green River Parkway project. The City of Stuart’s proposed NW Dixie Highway project is part of the East Coast Greenway (ECG) alignment in the “Northern Gap” portion of Martin County. This alignment was discussed at workshops with the Martin MPO’s advisory boards in 2014 and 2015. The NW Dixie Highway project would help connect the Green River Parkway portion of the ECG with the middle and southern portions through Martin County, connecting to existing and proposed ECG-designated trails in Palm Beach County. Requested Grant Award – The total estimated project cost is $464,517 ($379, 261 grant funds and $85,256 of local/City of Stuart funds). Budgetary Impact – None. The City acknowledges and agrees that it will be solely liable to the County for all costs associated with the Project, upon funding approval from FDOT. Prior to the County’s issuance of a Notice to Proceed to the Contractor, the CITY agrees to provide: 1) the total Bid Award, including a fifteen percent (15%) contingency amount, 2) twelve percent (12%) of the total Bid Award for Construction Engineering & Inspection (CEI) services, and 3) a Four Thousand Five Hundred Dollar ($4,500.00) nonrefundable Contract Administration Fee. Annual Operating Cost - Staffs time to administer the grant which is funded by the City of Stuart (via an Interlocal Agreement) as part of the nonrefundable contract administration fee. PERMISSION TO APPLY FOR A SOUTH FLORIDA WATER MANAGEMENT DISTRICT (SFWMD) COOPERATIVE FUNDING PROGRAM (CFP) GRANT FOR THE ENGINEERING IRRIGATION H2O CONSERVATION PROJECT Requestor – Field Operations Division / Engineering Department Granting Agency – South Florida Water Management District (SFWMD) Project Description – This project involves water conservation upgrades to the irrigation systems at eight enhanced right of way landscape sites in the County. These sites are irrigated with potable water, and were identified because they have the highest water consumption rates of the Engineering Department sites. The project includes replacement of existing battery operated controllers with solar powered controllers, and installation of soil moisture sensors in each of the zones of the landscape sites. Recent studies indicate that incorporation of soil moisture sensors into irrigation system can reduce water consumption by 20-40%. This grant request is for 50% of the estimated total replacement cost. Requested Grant Award – $10,000 Budgetary Impact – The estimated total cost for this project is $20,000. If successful in obtaining this grant, $10,000 would be used as match, and would come out of the Field Operations contracted services budget. Annual Operating Cost – Expected O&M costs is for maintaining the irrigation is expected to remain static. Monthly irrigation inspections already occur at all of the sites, and will continue at these sites. ALTERNATIVE ACTION: Programmatic Implication if not approved – The purpose of the replacement is to improve water conservation efforts and reduce the Field Operations Division costs of irrigation. Martin County manages such projects for the City because Martin County is FDOT LAP Grant Certified. Per the Interlocal Agreement, the City acknowledges and agrees that it will be solely liable to the County for all costs associated with the Project. Prior to the County’s issuance of a Notice to Proceed to the Contractor, the City agrees to provide: 1) the total Bid Award, including a 15% contingency amount, 2) 12% of the total bid Award for Construction Engineering & Inspection (CEI) services to be performed by Martin County staff, and 3) a $4,500 non-refundable Contract Administration Fee. The City of Stuart has submitted a check to the BOCC for $331,083.67 for this project. Breakdown of the check is as follows. PERMISSION FY17 TO AWARD THE DORI SLOSBERG DRIVER’S EDUCATION TRUST FUND FOR Through the Dori Slosberg Driver Education Safety Act created in 2002, the Martin County Clerk of Court collects an additional $5 with each civil traffic penalty. The Budget Office has reviewed the request and determined that it complies with the requirements of Section 318.1215 Fla. Stat. and Section 47.153, General Ordinances, Martin County Code. On March 11th 2016, MPO staff facilitated a screening committee meeting consisting of multidisciplinary staff members to solicit input regarding project feasibility, opportunities and challenges. The City of Stuart submitted an application for the NW Dixie Highway Sidewalk Project. This project was deemed in compliance with the comprehensive program goals and project evaluation criteria. Staff notes that the City' s project will complete a missing link of sidewalk that is also part of the East Coast Greenway alignment through Martin County. As you know, the Green River Parkway in Jensen Beach is designated as a portion of the East Coast Greenway, the 2,9oo+ mile national trail between Maine and Key West A section of the ECG runs through the Seabrancb State Preserve in Hobe Sound, and another portion is located in Jonathan Dickinson State Park. The City of Stuart's proposed NW Dixie Highway Project is part of the ECG alignment in the "Northern Gap" portion of Martin County. FDOT sugges ted a jurisdicllonal transfer of the segment of SR 707 from south of the drawbridge to NE Savannah Road to either the City of Stuart or Martin County, including the Old Roosevelt Bridge and perpetual operalion of the drawbridge. would be required in order for a single lane roundabout to be constructed . Thi s proposal wa s not accep table to either local governments and the intersection design was then completed as a signalized 'T' intersection. Recenlly, city staff approached FDOT as to the poss1b1lity of a jurisdictional transfer of the segment of SR 707 from sou th of the Old Roosevell Bridge lo NE Savannah Road to the City of Stuart. excluding the bridge section. BACKGROUND: 1. Recipient has applied to the County for a grant of money ("Grant") for the fiscal year 2016/17 ("Grant Period" October 1 - September 30) on the terms and conditions set forth herein. 2. The County has agreed to provide $85,000 for the Grant Period on the terms and conditions set forth herein. NOW, THEREFORE, in accordance with the mutual covenants hereinafter contained and other good and valuable consideration, the receipt and adequacy of which are hereby acknowledged, the parties agree as follows: 1.0 Disbursement and Use of Fund 1.1 Disbursements for the Grant Period will be made in accordance with the schedule set forth in Exhibit "A" attached hereto and incorporated herein by this reference. Provided however, disbursements are specifically contingent upon the amount of funds collected by the Clerk for this program. 1.2 The Grant shall only be used for the purposes set forth in the Grant Application, attached as Exhibit "B" and incorporated herein by this reference as well as the requirements of Section 47-153.General Ordinances Martin County Code and Section 318.1215 Florida Statue. Further requirements set forth in Exhibit “A”. 1.3 The recipient hereby certifies that the grant funds will be used solely for “enhancement and not replacement of driver education program funds and that such funds shall be used for direct educational expenses and shall not be used for administration” as required by Section 318.1215, Fla. Stat. The recipient hereby certifies that its driver education program funded by this grant requires a minimum of 30% of a student’s time in the program be behind the wheel-training as required by Section 318.1215 Fla. Stat. 1.4 The recipient shall maintain adequate internal controls in order to safeguard the Grant. 1.5 If the Recipient cannot use all or any portion of the Grant after the Grant has been disbursed, then all unused funds must be promptly returned to the County. 1.6 On an annual basis, the Recipient shall submit to the County either: a) an Audit Report if grant funds exceed $50,000; b) a Review Report if grant funds are between $25,000 to $50,000 (or an Audit Report if available); or c) a Compilation Report if grant funds are below $25,000 as each of the foregoing terms is defined by the American Institute of Certified Public Accountants (AICPA). 1.7 In the event the Audit Report, Review Report, Compilation Report, or financial records reveal that the Grant funds were not used for the purposes set forth in the Grant Application, then the County may require the Recipient to return all unused funds and reimburse the County for improperly used funds. 1.8 The Recipient shall maintain adequate records to fully document the use of the Grant funds for at least three (3) years after the completion of this Contract. The County shall have access to books, records, and documents as required in this Section for the purpose of inspection or audit during normal business hours, at the County's expense, upon five (5) days prior written notice. 1.9 The Recipient shall comply at all times with all applicable federal, state, and local laws, rules, and regulations. 1.10 Reports The recipient shall submit an Annual Performance Report to the County within fifteen (15) business days following: June 30, 2017. 1.11 Transfer Of Funds Between Budget Categories Recipient may transfer funds between budget categories as long as the total amount of transfer (increase or decrease) does not exceed ten (10) percent of the total approved budget category and the transfer is made to an approved budget line item. 1.12 Prior Written Approval Of Changes To The Contract Recipients shall obtain prior written approval from the County for the following changes to the items set forth in Exhibit B and failure to comply shall be cause for the County to terminate this contract pursuant to Section 4.0 hereof: a. Change in project activities, or plans set forth in the approved Grant Application; b. Transfers of funds above the ten (10) percent cap shall be made only if a revisedbudget is approved by the County Administrator or his designee. 1 of 5 79 of 113 c. 2.0 Indemnification 2.1 3.0 5.0 Except to the extent limited by F.S. 768.28, the Recipient shall indemnify and save harmless and defend the County, its agents, servants, and employees from and against any and all claims, liability, losses, or causes of action which may arise from any misconduct, negligent act, or omissions of the Recipient, it agents, servants or employees in the performance of services under this Contract. Availability of Funds 3.1 4.0 Under no circumstances can transfers of funds increase the total budgeted award. Transfers do not allow for increasing the quantitative number of items documente in any approved budget line item. (For example, equipment items in Operating Capital Outlay or Expense categories or staff positions in the Salaries and Benefits category.) The obligations of the County under this Contract are subject to the availability of funds lawfully appropriated for its purpose by the Board of County Commissioners of Martin County. Termination 4.1 This Contract may be terminated by either party in the event of a substantial failure by the other party to perform in accordance with the terms of the Contract upon thirty (30) days prior written notice. 4.2 In the event the County terminates this Contract, the Recipient shall return all funds not used as of the date of termination to the County within ten (10) calendar days. Nothing herein shall be construed as creating any personal liability on the part of any officer or agent of the County which may be a party hereto, nor shall it be construed as giving any rights orbenefits hereunder to anyone other than the County or the Recipient. Remedies, Choice of Law, and Enforcement Costs 7.1 This Contract shall be governed by the laws of the State of Florida and any and all legal action instituted because of this Contract shall be instituted in Martin County. 7.2 No remedy herein conferred upon any party is intended to be exclusive of any other remedy and each and every such remedy shall be cumulative and shall be in addition to every other remedy given hereunder or now or hereafter existing at law or in 2 of 5 80 of 113 equity or by statute or otherwise. No single or partial exercise by any party or any right,power, or remedy hereunder shall preclude any other or further exercise thereof. 7.3 8.0 If any legal action or other proceeding is brought for the enforcement of this Contract or because of an alleged dispute, breach, default or misrepresentation in connection with any provisions of this Contract, the prevailing party shall be entitled to recover reasonable attorney's fees, court costs and all expenses even if not taxable as court costs including, without limitation, all such fees, costs and expenses incident to appeals, incurred in that action or proceeding, in addition to any other relief to which such party or parties maybe entitled. Nondiscrimination The Recipient warrants and represents that all of its employees are treated equally during employment without regard to race, color, religion, physical handicap, sex, age, national origin or ancestry. 9.0 Entirety of Contract This Contract incorporates and includes all prior negotiations, correspondence, conversations, agreements, and understandings applicable to the matters contained herein and the parties agree that there are no commitments, agreements, or under-standings concerning the subject matter of this Contract that are not contained in this document. Accordingly, it is agreed that no deviation from the terms hereof shall be based upon any prior representations or agreements, whether oral or written. It is further agreed that no modification, amendment or alteration in the terms and conditions contained herein shall be effective unless contained in written document executed with the formality and of equal dignity herewith. 10.0 Severability If any term or provision of this Contract or the application thereof to any person or circumstance shall, to any extent, be held invalid or unenforceable for the remainder of this Contract, then the application of such term or provision to persons or circumstances other than those as to which it is held invalid or unenforceable shall not be affected, and every other term and provision of this Contract shall be deemed valid and enforceable to the extent permitted by law. 11.0 Captions Captions in this Contract are included for convenience only and are not to be considered in any construction or interpretation of this Contract or any of this Contract provisions.
