City services are an essential part of the safety of the community, and the City places a high value on the snowclearing of these essential services. It is a requirement of the tender that the successful contractor have the equipment (minimum as listed), the experience and the manpower to perform this essential service. 1.2 Liability for Errors The CITY OF ORILLIA has used considerable effort to ensure that information presented herein reflects, with reasonable accuracy, the nature of the goods and/or services requested and its factual components. The information is supplied as a guideline for respondents and may not be completely accurate, comprehensive or exhaustive. The CITY OF ORILLIA does not make any representation, warranty or guarantee as to the accuracy of the information contained herein. It is the respondent's responsibility to avail itself of all necessary information to prepare a response to this TENDER. If respondents have any questions or issues they feel need to be addressed, contact the TENDER Co-Ordinator. 1.3 Definitions For the purposes of this document, the following definitions shall apply except where noted otherwise: a) THE CITY OF ORILLIA - The CITY OF ORILLIA is an incorporated municipality in the County of Simcoe. b) TENDER Co-Ordinator- The specific CITY OF ORILLIA employee or other person that has been appointed by the CITY OF ORILLIA as the TENDER Co-Ordinator. c) Respondent- Any individual, partnership, corporation or legal enterprise submitting tender(s). d) Tender(s)- The offer submitted by a respondent. e) Award - The acceptance by the CITY OF ORILLIA of a tender(s), by a respondent, to furnish specific commodities and/or services as identified and specified herein. f) Successful Respondent- Any respondent to whom a Contract is awarded. 4 THE CITY OF ORILLIA Request for Tender SNOW CLEARING 2016-2019 2 2. 1 SUBMISSION OF TENDER Submission Requirements Three (3) complete tenders are to be submitted. One bid document must have an original signature. Sealed tenders clearly marked "TENDER - SNOWCLEARING", will be received until12:00:00 p.m. local time on SEPTEMBER 16, 2016 by: The City of Orillia 50 Andrew Street South, Suite 300 ORILLIA ON L3V 7T5 Attention: Kyle Cox On or before: September 16, 2016 DATE: 12:00 p.m . local time An authorized representative at the above address will time and date stamp the tender. THE CITY OF ORILLIA will not accept tender(s) beyond the closing time/date as set out in the TENDER documents. Tenders received after the specified time and date of this TENDER closing will not be considered and will be returned to the respondent unopened. Delivery to any other location other than the specified location will be disqualified. In the event of a mail strike or any disruption in mail services, it is the responsibility of the respondent to ensure that the bid is received at the specified location . Electronically transmitted tenders (i.e. FAX or e-mail, etc.) will not be considered. The bid must be submitted on the TENDER form as provided by THE CITY OF ORILLIA. No changes may be made to tender(s) after they have been received. Bids must be legible and completed in ink or typewritten. Erasures, overwriting, strike-outs will not be reason for rejection, provided all such changes rem ain legible and have been initialled by the authorized signatory of the respondent. 2.2 Withdrawal, Amendment and Disqualification A respondent that submits a tender to THE CITY OF ORILLIA may withdraw its tender only by giving written notice to the TENDER Co-Ordinator before the closing time that the respondent is withdrawing its tender. A respondent can amend a tender by submitting an amended tender in a sealed envelope to the above mentioned address before the closing time. The last tender received by THE CITY OF ORILLIA before the closing time shall supersede and invalidate any tender previously submitted by the respondent. THE CITY OF ORILLIA shall return, unopened any submitted tender that has been withdrawn or amended. 5 THE CITY OF ORILLIA Request for Tender SNOW CLEARING 2016-2019 THE CITY OF ORILLIA, without liability, cost or penalty, in its sole discretion, may disqualify any tender before the tender is fully evaluated, if: • • It contains false information. The tender reveals a conflict of interest as described in "Conflict of Interest". Tender(s) may be withdrawn prior to closing by notification of same in w riting, or in perso n, to the TENDER Co-Ordinator or specified designate. 2.3 Interpretation Wherever the amount proposed for an item does not agree with the extension of the quantity and the unit price, the unit price shall govern and the total price shall be corrected accordingly. W here the words "must", "shall", "will" or "mandatory" appear in this TENDER, the clause is to be considered as a mandatory requirem ent. 2.4 Force Majeure Force majeure is causes beyond a party's control, which are not avoidable by the exercise of reasonable f oresight. Neither party shall be responsible for any delay or failure to perform its obligations under this agreement by reason of force majeure. If either party is unable to perform any of its obligations in this Contract by reason of force majeure, including fire or other casualty, strike, order of a public authority, Act of God, or other cause beyond the reasonable control of such party, then such party shall be excused from such perform ance of the Contract for the duration of such cause. In the event such inability to perform shall continue longer than 30 days, either party may terminate this agreement without further liability by giving written notice to the other party. 2.5 Limitations of Damages The respondent, by submitting a tender, agrees that it will not claim damages in excess of an amount equivalent to the reasonable costs incurred by the respondent in preparing its tender for matters relating to the agreement or in respect of the competitive process, and the respondent, by submitting a tender, waives any claim f or loss of profits if no agreement is made with the respondent. 2.6 Mandatory Req uirements for Compliance Appendix A- Respondent's Information Form Appendix B- Respondent's Ability and Experience Form Appendix C- Tender Form Appendix D - Equipment 6 THE CITY OF ORILLIA Request for Tender SNOW CLEARING 2016-2019 2.7 Schedule of Events Release of TENDER Last day for questions, errors or omissions from respondents: TENDER Closing: Evaluation of Tender(s) Award of the Contract (after approval by THE CITY OF ORILLIA) 3 August26 September 9 September 16 Sept 16 - Oct 1 Oct 1 CLARIFICATION OF MATTERS RELATING TO THE TENDER 3.1 TENDER Co-Ordinator Respondents that wish to obtain further information about the TENDER and its process must submit their questions, by e-mail or facsimile to the TENDER Co-Ordinator listed below. Under no circumstances shall the respondent rely upon any inform ation or instructions from any other employee of THE CITY OF ORILLIA or its agents unless the TENDER Co-Ordinator provides the information or instructions in writing. Neither THE CITY OF ORILLIA, nor their respective employees, or agents shall be responsible for any information or instructions provided to the respondent, with the exception of information or instructions provided in writing by the TENDER Co-Ordinator. TENDER Clarification Report all discrepancies, omissions, errors, departures from building by-laws, codes or good practice, and points considered to be ambiguous or conflicting to the TENDER Co-Ordinator in writing, before the bid closing date so that THE CITY OF ORILLIA may issue instructions, clarifications or amendments by addendum to all respondents prior to the bid closing date. 3.3 Addendum The CITY OF ORILLIA, without liability, cost or penalty may, at any time prior to the closing time alter any details in this TENDER. In the event that this TENDER is amended via addendum, the remainder of the TENDER that has not been modified shall remain unchanged. Addenda may be necessary for: • correction of the TENDER and related forms; 7 THE CITY OF ORILLIA Request for Tender SNOW CLEARING 2016-2019 • • • • • extension of the submission deadline; clarification of parts of the TENDER; retraction or cancellation of the TENDER; responses to bidders questions; other additions to, deletions from or alterations to the requirements contained in the TENDER. Addenda will be available or sent by the following- the bidder will be responsible to ask the co-ordinator prior to the close of the tender if any addenda have been issued • • • 4 Facsimile or Electronic mail. City's website- www.orillia.ca bids and tenders GENERAL TERMS Tenders, which are incomplete, conditional, obscure, or contain alterations, or irregularities of any kind, may be rejected. Each proponent must make its own estimates of facilities and difficulties to be encountered in completion of the work. Failure to comply with the requirements expressed herein may result in disqualification of the Tender. By submitting a Tender the Respondent represents that it has the legal capacity to enter into a Contract and is in compliance with all federal, provincial and municipal laws and regulations applicable to the submission of the Tender and entry into the Contract for the project. 4.1 Irrevocability Subject to the respondent's right to withdraw a tender prior to the closing time, all tenders will be irrevocable for a period of ninety (90) days after closing of the TENDER. 4.2 Subcontracting The successful respondent shall not assign or subcontract any part of this agreement without prior written consent of the TENDER Co-Ordinator. No permitted assignment or subcontract shall relieve the respondent from its obligations arising from the TENDER or impose any liability upon THE CITY OF ORILLIA to any assignee or subcontractor. The respondent shall at all times be held fully responsible for the acts and omissions of the assignee's or subcontractor's directors, officers, employees, independent contractors, subcontractors, shareholders, agency's, partners and volunteers. THE CITY OF ORILLIA shall not permit the respondent to subcontract to any entity or individual whose current or past corporate or other interests may, in THE CITY OF ORILLIA's opinion, give rise to a conflict of interest in connection with the project to be undertaken or the services to be provided pursuant to this TENDER. This includes, but is not limited to, any entity or individual involved in the preparation of the respondent's tender. 8 THE CITY OF ORILLIA Request for Tender SNOW CLEARING 2016-2019 Further, in addition to or in lieu of any other remedies that THE CITY OF ORILLIA has in law or in equity, THE CITY OF ORILLIA shall have the right to term inate the agreement in the event that THE CITY OF ORILLIA in its sole discretion determines that the selected respondent has contravened the prohibition set forth in the preceding paragraph. Contact Linda House at Bus: (705) 326-1844 Fax: (705) 326-0774 E-mail : orilliaconstruction@yahoo.ca 4.3 Risk of Loss All risk of loss or damage to property or supplies provided by the respondent or provided by any third parties in connection with this TENDER shall remain with and be upon the respondent. 4.4 Claims or Possible Claims THE CITY OF ORILLIA will preclude a respondent from bidding if such respondent has made a formal demand or otherwise put THE CITY OF ORILLIA on notice for a pending action or is involved in any actual litigation proceedings, (excepting only construction lien demands, notices or proceedings) by or against or otherwise involving THE CITY OF ORILLIA, until a final decision is rendered and for three years. 4.5 Termination In addition to all of THE CITY OF ORILLIA other remedies, if a selected respondent fails to execute an agreement within 30 days of notice of selection, THE CITY OF ORILLIA may, in its sole and absolute discretion and without incurring any liability, rescind the selection of the respondent. In the event of failure to execute as aforesaid, or that the successful respondent does not, in the opinion of THE CITY OF ORILLIA, comply with the specifications and terms of this Contract at any time throughout the duration of the Contract, or if THE CITY OF ORILLIA, in its sole and unfettered discretion determines that either their service or the product/equipment provided by the successful respondent is unsatisfactory at any time during the term of the Contract, THE CITY OF ORILLIA reserves the right to immediately terminate the Contract in its entirety and to remove the successful respondent from eligibility to subm it future tenders for an indeterminate period thereafter. 4.6 Freedom of Information All tenders submitted to THE CITY OF ORILLIA, and all its agencies are subject to the provisions of the Municipal Freedom of Information and Protection of Privacy Act ("MFIPPA"), R.S.O. 1990, c.M.56, as amended. The MFIPPA provides all persons with a legal right of access to information in the custody and/or control of THE CITY OF ORILLIA subject to a limited set of exemptions. One such exemption is information that reveals a trade secret of scientific, technical, commercial, financial or labour relations information, supplied in confidence by a third party, where disclosure could reasonably be expected to result in certain harms. In accordance with the MFIPPA, respondents are reminded to clearly identify in their TENDER material, any specific scientific, technical, commercial, proprietary, or similar confidential information. The disclosure of which could cause them injury or damage, respondents are encouraged to place all such details and information within a separate section of their submission. 9 THE CITY OF ORILLIA Request for Tender SNOW CLEARING 2016-2019 Despite the above, submission by the bidders of a tender shall be deemed to be consent by the bidder: • To the disclosure of the tender or any part thereof, to individuals in THE CITY OF ORILLIA as may be necessary for the purpose of reviewing and evaluating the tender. • To THE CITY OF ORILLIA making copies of the tender for the purpose of reviewing and evaluating the tender. • To the retention of the tender by THE CITY OF ORILLIA. • To the public disclosure of the name of the bidder. 4.7 Personal Information Any personal information as defined above of the Municipal Freedom of Information and Protection of Privacy Act that is collected as part of this process, shall be used only to assess the qualifications of the individuals with respect to providing the required projecUservices, or a consistent purpose. 4.8 Conflict of Interest The respondent must confirm that the respondent does not and will not have any conflict of interest (actual or potential) in submitting its tender or, if selected, with the contractual obligations of the respondent as contractor under the agreement. Where applicable, a respondent must declare in its tender any situation that may be a conflict of interest in submitting its tender or, if selected, with the contractual obligations of the respondent under the agreement. 4.9 Indemnification The respondent shall indemnify and save harmless THE CITY OF ORILLIA and THE CITY OF ORILLIA's employees, trustees and officers, independent contractors, subcontractors, agents, volunteers, successors, and assigns, of any and all losses, costs, damages including but not limited to, incidental, indirect, special and consequential damages, or any loss of use, revenue or profit by any person, organization or entity. Liabilities include but are not limited to, any and all liability for damages to property and injury to persons (including death), judgements, claims, demands, causes of action, contracts, suits, actions or other proceedings of any kind. Any expenses including but not limited to, legal fees for solicitor which indemnified persons, entitles or organizations or any of them , may suffer or incur howsoever caused arising out of or in connection with, in any way related to, or as a result of: • Anything done or omitted to be done by the respondent or the respondent's personnel with respect to their obligations under the Contract or otherwise in connection with this TENDER, including any breach by the respondent of its obligations under this Contract or any breach by the respondent representations, warranties and covenants set forth in the respondent tender; and • Any alleged infringement or infringem ent of any patent, copyright, trade mark, trade secret, or other intellectual or industrial property right or contractual right or obligation of any third party by reason of the purchase, use or possession of any of the services or deliverables under this Contract. 10 THE CITY OF ORILLIA Request for Tender SNOW CLEARING 2016-2019 4.10 Insurance The respondent agrees to implement and submit proof of insurance upon award of the Contract. The insurance must be maintained for the duration of the Contract at their own cost and expense, in such amount, in such forms and with insurers acceptable to THE CITY OF ORILLIA. The successful respondent must carry public liability and property damage insurance in the amount of not less than five million dollars ($5,000,000.00) per occurrence. THE CITY OF ORILLIA must be added as an additional insured to such policy and such policy must contain a cross liability clause, a wavier of subrogation clause in favour of THE CITY OF ORILLIA and a thirty day prior notice clause of any cancellation or material change in coverage, terms and conditions. The successful respondent must submit proof of this insurance before the Contract begins. 4.11 Regulation Compliance and Legislation The successful respondent shall ensure all products and services provided in respect to this Contract are in accordance with and under the authorization of all applicable authorities, municipal, provincial, and federal legislation, including, but not limited to; the Occupational Health & Safety Act of Ontario, Workplace Safety & Insurance Act and Environmental Protection Act. The successful respondent will provide the TENDER Co-Ordinator with a copy of a current Workplace Safety & Insurance and Clearance Certificate indicating the contractor's good standing with THE CITY OF ORILLIA prior to the official award or commencement of any work. The successful respondent will provide THE CITY OF ORILLIA prior to commencement of work, with a written copy of the Health and Safety Policy for their firm along with Health and Safety procedure(s) relevant to the work to be performed, where appl icable. If the firm does not have written procedures relevant to the work, then the firm will be expected to abide by THE CITY OF ORILLIA'S safety procedures in accordance with the Occupational Health and Safety Act (re: duties of employers). By submitting a tender the proponent represents that it has the legal capacity to enter into a Contract and is in compliance with all federal, provincial and municipal laws and regulations applicable. This competitive process, including any process Contract, shall be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein. 4.12 Facilities Evaluation THE CITY OF ORILLIA reserves the right to visit the respondents field operations, facilities, audit the work procedures, work performance, and equipment and safety awareness to ensure that the respondent and staff are qualified to perform the work. 4.13 Cost of Tender The respondent shall assume all costs related to the preparation and drafting of their tenders and THE CITY OF ORILLIA shall, in no circumstances, be liable to compensate respondents for such costs. 11 THE CITY OF ORILLIA Request for Tender SNOW CLEARING 2016-2019 4.14 Credit and Reference Check THE CITY OF ORILLIA shall be entitled to verify the respondent's credit and financial situation at any time during the TENDER process. 4.15 Collusion and Corruption A reasonable suspicion or collusion between two or more respondents shall be sufficient cause for the rejection of all tenders so affected. 5 BID OPENING AND EVALUATION 5.1 Bid Opening Bids are opened at the submission office following submission of tender(s). 5.2 Evaluation THE CITY OF ORILLIA without liability, cost or penalty, in its sole discretion, may disqualify any tender before evaluation is fully completed if: • • • It contains false inform ation; The tender, on its face, reveals a conflict of interest; The respondent misrepresents any information provided in its tender. Submissions will be evaluated based on respondents who have conformed with all aspects to the TENDER and who are capable of performing the Contract requirements and the integrity and reliability, which will assure good faith performance. Respondents must include in their submissions any relevant information that would allow THE CITY OF ORILLIA to accurately assess their organization with regards to evaluation criteria. No assumptions will be made. THE CITY OF ORILLIA shall consider each submission and after such consideration, shall have the right to do one or more of the following: 1. Require any/all of the respondents to attend individual interview(s)/presentation(s) to clarify their submission. 2. Develop a short list and conduct negotiations with all short listed respondents. 3. Examine equipment specified in the tenders. THE CITY OF ORILLIA reserves the right to waive formalities and accept a bid, which, in THE CITY OF ORILLIA's discretion, is substantially compliant. Should THE CITY OF ORILLIA receive non-compliant tender(s), THE CITY OF ORILLIA, in its discretion, may re-bid the project. 12 THE CITY OF ORILLIA Request for Tender SNOW CLEARING 2016-2019 THE CITY OF ORILLIA may contact any one or more respondents to request information without any obligation to contact or request the same information from any other respondent. 5.3 Criteria Each tender will be evaluated based on the following factors listed (not necessarily in this order) for compliance with TENDER requirements: 5.4 • Cost • Past performance • References • Ability to meet/exceed all specifications and requirements Award The term of this contract begins October 1, 2016, and continues up to and including the LAST snowfall in spring of 2019. The contract MAY be extended for 2 (two) additional seasons at the discretion of the City of Orillia, if City and contractor mutually agree on terms on a per season basis. It is not the intent of The City of Orillia to award this TENDER to any respondent that does not furnish satisfactory evidence of possessing the ability and experience in this class of requirement and, sufficient capital and plant to ensure acceptable performance and completion of the service. By submitting a Tender, the respondent acknowledges that it has read this TENDER, understands it, and agrees to be bound by its requirements. The respondent also agrees that the TENDER together with the Successful Respondent's tender will be the complete and exclusive statement of the agreement between THE CITY OF ORILLA and the Successful Respondent and will supersede all other documents including contracts, purchase orders and invoices. Any minor negotiations will be included as Addenda. NO RESPONDENT CONTRACT WILL BE SIGNED THE CITY OF ORILLIA reserves the right to reject any submitted tender from any respondent, who in THE CITY OF ORILLIA's reasonable opinion, is deemed incapable of providing the necessary labour, materials, equipment, financing and management resources to perform the work in a satisfactory manner. 5.5 Default by the Successful Respondent In the event that the successful respondent(s) is found in non-compliance with the terms/requirements hereof or in supplying and delivering the goods and/or services in accordance with the terms/requirements, the Contract may be cancelled at the full discretion of THE CITY OF ORILLIA. 5.6 Clarification/Waiver Without prejudice to this right, THE CITY OF ORILLIA may seek clarification and request additional information in relation to the tender after the submission deadline where any respondent's intent is unclear and may waive or request or amend where, in the opinion of THE CITY OF ORILLIA there is a minor irregularity or om ission in the information that is to be submitted in a required document. 13 THE CITY OF ORILLIA Request for Tender SNOW CLEARING 2016-2019 5. 7 Right to Negotiate After the Contract has been awarded to the successful respondent, THE CITY OF ORILLIA reserves the right to negotiate minor changes, amendments or modifications to the respondent's submission, without offering the other respondents the opportunity to amend their submissions. The City further reserves the right to add services or delete any site or service called for in the Specification if in the best interest of The City to do so. 5.8 Settlement of Disputes In the event of any dispute or claim arising between THE CITY OF ORILLIA and the respondent as to their respective rights and obligations under the Contract, either party may give the other written notice of such dispute or claim. The notification of dispute or claim shall be made within fourteen days of the dispute or cause of action arising. If the dispute or claim cannot be resolved through negotiation to the satisfaction of both parties, the parties may between themselves agree to submit the particular matter to arbitration in accordance with the laws of Ontario. If no agreement is made for arbitration, then either party may refer such dispute to the appropriate judicial tribunal as the circumstances may require. 5.9 News Release/Publicity The successful respondent shall not make any news rel ease concerning the TENDER, submitted tender or awarding of the same or resulting Contract without the express written consent of THE CITY OF ORILLIA. An award of Contract to a successful respondent does not constitute a general endorsement of the respondent's products or services, and the award of Contract cannot be used by the successful respondent to promote the sale of products or services, without the express written approval of THE CITY OF ORILLIA. 6 6.1 PRICING Pricing Prices entered on the attached bid sheet(s) shall be net prices, in Canadian dollars, all costs must be included in the unit cost of the item (i.e. fuel charge, shipping, administrative costs, etc.). Freight on board (FOB) destination shall include duty, custom clearance, exchange and all other charges. Bids received with any extra charge over and above the item price will be rejected. Unit pricing, applying to all participating agencies of THE CITY OF ORILLIA, will govern where mathematical errors may occur in the extension of prices . Where it appears the respondent may have made an error in the calculation, THE CITY OF ORILLIA shall consider the intent of the respondent and may accept the tender for consideration and subsequent correction. APPENDIX D - EQUIPMENT EQUIPMENT List of snow-rel ated owned (or having a current exclusive long-term lease) by the Bidder: 20 THE CITY OF ORILLIA Request for Tender SNOW CLEARING 2016-2019 APPENDIX E- SPECIFICATIONS 7.0 SPECIFICATIONS 7.1 Snow clearing to be completed between 12:00 Midnight and 6:00 am (except in extraordinary storm conditions), from first significant snowfall in the fall of 2016 to the last significant snowfall in the spring of 2019. Lot 10 has to be cleared by 5:00 a.m. due to the tenant's use of the facilities in the fitness centre. 7.2 Snow clearing shall be done promptly following a "significant" snow accumulation. Over 5 em (2 inches) of drifted or fallen snow is considered "significant" accumulation. 7.3 For the snowclearing, quote a lump sum contract price per season per area. Sanding will be quoted on a cost per lot per time. Payment will be made to the contractor the last week of November, December, January, February and March - 5 equal payments. 7.4 Drawings of the snow clearing areas are included, indicating the areas where snow may be stockpiled on the site. 7.5 Removal of snow from the sites, if required by a severe winter, will be charged at a cost per hour for the equipment shown on the attached Quotation Form , which will include the cost of the operator. The snow will be dumped at the City's landfill site, as directed by the Site Manager, normally at Site #2, in conjunction with City's snow removal activity. NOTE: Police Station, Lot #3, Fire Station #2, Fire Station #2, Lot 4 and the Orillia City Centre- There is very limited snow storage area for these locations and frequent removal of the snow will be required and is to be included as part of the contract. NOTE: The contractor will require a rubber-wheeled front-end loader and dump truck to remove the snow from these areas, as well, during those circumstances when the City requires additional snow removal. NOTE: Snow removal from the sites will be carried out upon direction I request from site staff. With the exception of the sites that are included in the contract price. Snow removal must be maintained at all times on these sites (Police Station, Lot #3, Fire Station #2, Fire Station #2, Lot 4 and the Orillia City Centre) 7.6 Sanding of the sites, when required, will be charged at the per lot price as shown on the attached Quotation Form. This price will include the total cost of supplying and applying sand in a uniform manner to all slippery areas of the above noted lots. The successful Contractor will be responsible to monitor the conditions of the lots and respond when the conditions warrant a sanding operation . The City may request that additional sand/salt be applied. The Contractor shall maintain records of when sanding was required, and this item shall be submitted as a separate line item on the invoice, with the dates of the sanding service. G. Call Centre - 2 Hunter Valley Road . There are no areas w here the snow could be stockpiled. The snow will have to be plowed, piled and blow n into the pond area to the north and east of the lots. Due to the high volume of foot traffic, the parking lot needs to kept clear of ice and the application of straight salt, rather than a salt/sand mixture may be required. Can must be taken to avoid the blowing of snow into the drainage ditches, otherwise they will become blocked in the spring runoff. TeleTech is responsible for the sidewalk and doorway clearing . The call centre will be operating seven days per week, Monday to Saturday, 6:00 a.m . to 1:00 a.m., Sunday 10:00 a.m. to 11 :00 p.m. The lot shall be cleared prior to 5:00 a.m., Monday to Saturday, and prior to 8:00a.m. on Sundays. Significant snowfall during the day will require the Contractor to keep the lots clear to the best of their ability, but a minimum , the driving lanes and empty spaces shall be cleared . H.
