MEMORANDUM SALING PENGERTIAN
ANTARA
DEPARTEMEN PERTANIAN REPUBLIK INDONESIA
DAN
DEPARTEMEN PERTANIAN REPUBLIK RAKYAT CHINA
TENTANG
KERJASAMA DI BIDANG PERTANIAN
Departemen Pertanian Republik Indonesia dan Departemen Pertani.an Republik Rakyat
China (selanjutnya disebut sebagai kedua Pihak);
Mengingat hubungan kerjasama dan persahabatan yang ada diantara kedua negara dan
rakyatnya;
Mengakui bahwa kerjasama demikian akan kondusif untuk mengembangkan pertanian
secara bersama di kedua negara;
Telah menyepakati hal-hal sebagai berikut:
PASAL I
Kedua Pihak akan meningkatkan kerjasama ilmiah dan ekonomi di bidang pertanian
berdasarkan undang-undang dan peraturan yang terkait dari kedua negara masingmasing.
PASAL II
1.
Bidang kerjasama antara kedua Pihak meliputi tanaman pangan, alat dan mesin
pertanian, hortikultura, tanaman perkebunan, manajemen agribisnis, penelitian
dan pertanian dan pengembangan, petemakan dan industri terkait, industri
benih serta bioteknologi.
2.
Kedua Pihak telah sepakat untuk mengadakan kerjasama seperti disebutkan di
atas dengan cara sebagai berikut:
2.1.
Penelitian dan pelatihan tentang pertanian yang merupakan kepentingan
bersama.
2.2.
Pertukaran informasi ilmiah tentang pertanian.
2.3.
Penyelenggaraan lokakarya, seminar dan pameran tentang pertanian yang
merupakan kepentingan bersarna.
2.4.
Peningkatan investasi bersarna dan perdagangan dalam agribisnis dan
agroind ustri.
2.5.
Bentuk kerjasama lainnya yang disepakati bersarna oleh kedua Pihak.
PASAL Ill
Kedua Pihak akan mendorong lembaga negara dan badan-badan swasta, lembaga
pendidikan dan perguruan tinggi, lembaga-lembaga ilmiah dan teknologi serta
perdagangan untuk berperan secara aktif dan memperluas bidang-bidang yang
menjadi kepentingan bersama. Kerjasama akan ditingkatkan, termasuk pembentukan
badan usaha pertanian dan usaha patungan.
PASALN
1.
Kedua Pihak telah sepakat untuk membentuk Komite Bersarna untuk Kerjasama
di bidang Pertanian, yang akan bertanggungjawab untuk perencanaan,
koordinasi dan pemantauan kegiatan kerjasarna di bidang pertanian di kedua
negara.
2.
Komite Bersarna akan bertemu sekali dua tahun secara bergantian di Republik
Rakyat China dan Republik Indonesia untuk membuat rencana kerja dan
meninjau kembali pelaksanaan rencana kerja serta Memorandum Saling
Pengertian (MOU).
3.
Masing-masing Pihak akan menunjuk sekretaris penghubung untuk koordinasi
antar badan dan untuk tugas rutin dari Komite Bersama.
4.
Di tahun antara pertemuan Komite Bersarna, sekretaris penghubung dari kedua
Pihak akan bertemu secara bergantian di kedua negara untuk bertukar pikiran
dan pendapat.
PASAL V
1.
Dalam melaksanakan kegiatan yang berkaitan dengan MOU ini, pihak pengirim
akan menanggung biaya perjalanan ke luar negeri untuk para ahli yang
berkunjung (tidak termasuk ahli yang dipekerjakan), ilmuwan dan pejabat dan
pihak tuan rumah akan menanggung biaya asrama, penginapan dan transportasi
di negara tuan rumah.
2.
Pihak pengirirn akan memberitahu pihak tuan rumah dua bulan sebelum
keberangkatan tirn pengunjung dan memberikan informasj yang diperlukan.
PASAL VJ
1.
Kedua Pihak akan menjamin bahwa pertukaran informasi di bidang ilmu
pengetahuan dan teknik antara kedua Pihak, termasuk hasil penelitian yang
dilakukan menurut MOU, tidak akan dialihkan atau diberikan kepada pihak
ketiga tanpa persetujuan terlebih dahulu dari kedua Pihak secara tertulis.
2.
Mengenai masalah-rnasalah yang berkaitan dengan hak atas kekayaan
intelektual, yang mungkin timbul dalam kegiatan yang dilaksanakan menurut
MOU, kedua Pihak akan mernbuat persetujuan melalui konsultasi sebelum
melaksanakan kegiatan tersebut
PASAL VII
Kegiatan-kegiatan yang akan dilaksanakan menurut MOU ini tergantung pada
tersedianya dana dan personil dari kedua Pihak.
PASAL vm
Perbedaan-perbedaan yang timbul karena penafsiran atau pelaksanaan MOU ini akan
diselesaikan secara kekeluargaan melalui konsultasi atau perundingan di antara kedua
Pihak.
PASAL lX
1.
Memorandum SaJing Pengertian ini berlaku pada tanggal penandatanganan dan
tetap berlaku selama lima tahun. Jika saJah satu dari kedua Pihak tidak
memberikan pemberitahuan kepada pihak lain secara tertulis untuk mengakhiri
Memorandum Saling Pengertian ini enam bulan sebelum habis masa
berlakunya, maka Memorandum ini akan dengan sendirinya diperpanjang
untuk lima tahun berikutnya.
2.
Berakhimya Memorandum Saling Pengertian ini tidak akan mempengaruhi
keabsahan dan jangka waktu setiap kegiatan yang dilakukan menurut
Memorandum Saling Pengertian ini sampai selesainya kegiatan tersebut, kecuali
kedua Pihak menyepakati sebaliknya.
3.
Setiap perbaikan, tambahan atau penghapusan dapat dilakukan terhadap
Memorandum ini setiap waktu atas dasar persetujuan bersama oleh kedua
Pihak.
SEBAGAI BUKTI, yang bertandatangan dibawah ini, wak.il yang diberi Kuasa atas
nama masing-masing Pihak Lelah menandatangani Memorandum Saling Pengertian ini.

Memorandum of Understanding
Between
The Ministry of Agriculture of the Republic Indonesia and
The Ministry of Agriculture of the People's Republic of China
on Agricultural Cooperation
The Ministry of Agriculture of the Republic of Indonesia and the Ministry of
Agriculture of the People's Republic of China (hereinafter referred to as the
two Parties),
Bearing in mind the friendly and cooperative relations existing between the
two countries and their people.
Recognizing that such cooperation will be conducive to the mutual
development of agriculture in the two countries.
Have agreed as follows :
ARTICLE- I
The two Parties shall promote the scientific and economic cooperation in
the field of agriculture on the basis of abiding by the relevant laws and
regulations of their respective countries.
ARTICLE- II
1. The cooperative areas between the two Parties shall include major food
crops,
agricultural machinery, horticulture, perennial crops,
agribusiness management, agricultural research and development,
animal husbandry and relevant industries, seed industries and
biotechnology.
2. The two Parties have agreed to have the above mentioned cooperation
through the following ways and means.
2 .1 . Join research and training on agricultural subjects of common
interest;
2.2. Exchange of the scientific information on agriculture;
2.3. Organization of workshops, seminars and exhibitions on
agricultural subject of common interest;
2.4. Promotion of join investment and trade in agribusiness and agroindustry; and
2.5. Any other forms of cooperation that may be mutually agreed by the
two Parties;
ARTICLE - Ill
The two Parties shall encourage state and private agencies, colleges and
universities, science and technology institutions as well as commercial
organizations to actively participate in and expand the areas of interest.
The cooperation shall be promoted including the establishment of agroenterprises and joint ventures.
ARTICLE- IV
1.
The two Parties have agreed to establish a Joint Committee on
Agricultural Cooperation, which shall be responsible for planning,
coordinating and monitoring agricultural cooperation activities in the
two countries.
2.
The Joint Committee shall meet once every two years alternatively in
China and Indonesia to make a work plan and review the
implementation of the work plan and the Memorandum of
Understanding (MOU).
3.
Each Party shall designate its liaison secretary for coordination
between agencies and for the routine duties of the Joint Committee.
4.
In the year between sessions of the Joint Committee, the liaison
secretaries of the two Parties shall meet alternatively in the two
countries to exchange opinions and views.
ARTICLE-V
1.
When implementing activities related to this MOU, the sending Party
shall bear the international travel expenses for the visiting experts
(excluding the engaged experts), scientists and officials, and the host
party shall cover their expenses of board, lodging and transportation in
the host country.
2.
The sending Party shall inform the host Party two months before the
departure of the visiting team and provide necessary information.
ARTICLE-VI
1.
The two Parties shall guarantee that the scientific and technical
information exchanged between the two Parties, including the results
of the joint research conducted under this MOU, will be neither
transferred nor provided to a third Party without the agreement of both
Parties in written form in advance.
2.
With regard to the issues relating to the intellectual property, which
may arise in the activities carried out under this MOU, the two Parties
shall make an agreement through consultation before implementing
activities of this kind.
ARTICLE - VII
The activities to be carried out pursuant to this MOU are subject to the
availability of funds and personnel of the two Parties.
ARTICLE - VIII
Any differences arising out of the interpretation or implementation of this
MOU shall be settled amicably through consultation or negotiation between
the two Parties.
ARTICLE- IX
1.
This Memorandum of Understanding shall enter into force on the date
of its signature and remain in force for five years. Unless either of the
two Parties gives the other notice in writing to terminate the present
Memorandum of Understanding six months before expiration, this
Memorandum shall be automatically prolonged for a period of five
years.
2.
The termination of this Memorandum of Understanding shall not affect
the validity and duration of any activities made under this
Memorandum of Understanding until the completion of such activities,
unless the two Parties agree otherwise.
3.
Any revision, addition or deletion may be made to this Memorandum
at any time on the basis of mutual consent by the two Parties.
IN WITNESS WHEREOF, the undersigned, the authorized representatives
on behalf of their respective Parties have signed this Memorandum of
Understanding.

three texts being equally authentic. In case of any divergence of the
languages, the English text shall prevail.
