The cozy relationship between the
Mercury News and the City of San Jose
reminds me of the relationship that existed
between the newspaper Pravda and the
old Soviet Union. A case in point, the Mercury continues to report that the City has
offered the police a 9% raise over the next
two years. This was how they portrayed
the City’s offer in their Internal Affairs
column.
Raises have been the big topic of discussion at San Jose City Hall as officials
wrapped up the budget for the coming fiscal year. That’s a refreshing change from
the ugly fights with city unions over pay
cuts to reduce layoffs. But it doesn’t mean
there’s no bitterness as city leaders dangle
2.5-percent raises to workers who took
10-percent pay cuts. Even cops offered 9

percent over two years to keep them from
quitting say that’s not enough.
The City’s offer to police was not a
9% raise and to characterize it as such
is either a case of very lazy reporting on
the part of the Mercury or the paper has
chosen to assist the City in misleading the
citizens of San Jose.
Below is an email we sent to our members explaining that the “9% raise” isn’t
even close to a real 9% raise.
We have been asked by several members to explain the City’s offer they made
just prior to their Last, Best and Final offer
submitted to the Arbitration panel. We
understand the confusion because it has
been mischaracterized by the City and
some media outlets as a “9% raise.” This
is a deceitful and inaccurate description of
the City’s offer.
The actual City offer consisted of a
2.5% raise for the FY 13/14. Then a
contingent 2.5% raise in FY 14/15. The
string attached to us receiving the second
2.5% would be tied to the City realizing
$20 million in savings from some of their
Measure B changes. In other words, in
order for us to receive the second 2.5%
raise, we would either have to lose our
lawsuit or all of the bargaining units would
have to drop their lawsuits. That’s a whole
lot of string.
The City also offered a one-time, nonpensionable 4% retention bonus to be
paid toward the end of the FY 14/15 in
two 2% increments. Only if you stayed
would you be paid the 4%.
The 2.5% + 2.5% (contingent) + 4%
one-time retention bonus is how they get
to a “9% raise”. Its political spin for the
media and a way to confuse the public.
The following example should clarify what
an actual 9% raise would look like compared to the City’s “9% raise.”
If you are making $100 dollars a year
and you get a 9% raise, then you would
be making $109. It’s a pretty easy concept
to understand.
But under the City’s proposal, in FY
13/14 you would go from making $100 to
making $102.50. The second year’s 2.5%
raise is based on a contingency that is
highly unlikely to happen, so odds are you
will not get it.
The retention bonus, given to those still
here by the end of FY 14/15 is one-time
money. You would still be making $102.50
but you would get a check for $2 and then
another check for $2 as the 4% is broken
up into two payments. The retention bonus would not increase your hourly wage.
So in June of 2015 you would still be making $102.50 not $109.
Don’t forget, the City’s “9% raise” offer
came with takeaways on premium pay
and sick leave payout.
Do not be confused by the City’s “9%
raise” because it’s not one.

Santa Cruz police are looking for a suspect who shot and wounded a 36-year-old Oregon man
during an armed robbery of four people in Santa Cruz’s San Lorenzo Park on Monday night. The
victim was walking with two other men and a woman to downtown Santa Cruz at about 10
p.m. when the suspect approached and pointed a gun at them and demanded their wallets. He
fired the weapon and wounded the victim in the torso before any of them could comply. The
suspect then fled on foot with their wallets.
The suspect is described as a white man, 18 to 30 years old, 5 feet 8 to 5 feet 9 inches tall
with a thin build and dirty skin.

Bank Robbery

Police are asking for the public’s help in identifying and locating a man who robbed a bank in
Pleasanton. The Wells Fargo at 4765 Hopyard Road was robbed at about 11:10 a.m., police
said. The man approached a teller with a note that said he was robbing the bank. The suspect ran away with cash stolen from the bank. He spoke with a Jamaican or similar accent.

Spanish SWAT Team Arrests Dangerous Fugitive
The Spanish Policía Nacional released
video of their SWAT officers arresting
Mark Alan Lilley, one of Britain’s most
wanted fugitives in Malaga, Spain. In
2000, Lilley was on trial for drug trafficking in the UK when jumped bail and
fled. However his trial continued, he was
convicted and sentenced to 24 years in
prison. SWAT officers used ladders to
climb over the main gate of Lilley’s villa
and used a battering ram to knock down
the front door.
Officers found the Lilley hiding in a
secret room behind a closet. Lilley had a
computer where he controlled the security
cameras monitoring the grounds of the villa and his dogs alerted him. Police report
Lilley’s appearance had “changed considerably” and that he had become an expert
in “vale tudo,” a Brazilian martial art., The
Spanish police press release said Lilley’s
crimes date back to 1997 where a police
investigation revealed he was the leader
of a drug trafficking gang in the UK.

Undocumented Immigrants Can Obtain U Visa If They
If They Have Been Victims of a Crime
in the United States
In the last year dozens of undocumented immigrants have entered my office
and filed for U visas. They have been
victims of shotgun wounds to the chest
at close range, drive-by shootings, rape,
physical domestic violence, emotional
domestic violence, the sexual abuse of a
minor, gang violence, kidnapping, illegal
detention, criminal threats, and armed
assault. They are eligible for a U visa—a
work permit for 4 years with the option of
applying for permanent residence after 3
years.
Congress approved 10,000 visas annually plus an unlimited number of visas for
eligible derivative family members if they
(1) were the victim of a significant crime,
(2) suffered substantial hardship due to
the crime, and (3) cooperated with the police investigation of the crime and (if the
criminal is found) the prosecution of the
crime. Immigrants must report the crime
and make a statement, but there are ironclad protections written into the law that
protect victims from ICE or deportation
if they report the crime. Otherwise, no
undocumented immigrant would report
a crime and crime would increase in the
United States. It is indeed 100% safe to
report a crime without fear of deportation.
The benefits of the U visa include a
work permit, a valid social security card
and driver’s license, immediate eligibility
for public benefits and in state residency
for purposes of attending a public college (upon mailing the U visa application to Vermont!), and a path to a green
card and citizenship. The crime may
be from a long time ago; it need not be
recent. Persons who have been previously deported, who have committed a
crime themselves, or who are currently in
deportation proceedings are all eligible.

In my opinion, San Jose Mayor Reed
and the majority of the city council do not
want to use these numbers when spreading their lies about the San Jose Police
Department. They have clearly created a
hostile and dangerous working environment in the City of San Jose.
These numbers clearly tell the true
story. San Jose Mayor Reed and the
majority of the city council, as well as the
citizens of our city are lucky! They have
severely understaffed our police department compared to others cities, but because of the men and women who work
for the San Jose Police Department, we
have managed the persevere. The issue
that Mayor Reed and the majority of the
city council will not address is that even
at 2006 staffing levels, the City of San
Francisco, the next largest city in the bay
area outnumber our “Ratio of Citizens to

John Michael Enard
Sexual predator
On January 19, 2013 at approximately 1:38 a.m., John Michael Enard , B/M, DOB: 03/17/1954,
removed his GPS Tracking device and climbed over a fence and left a half way house, the
Southeast Texas Transitional Treatment Center in Harris County, Texas.
He was a Sexually Violent Predator paroled to the center on December 11, 2012 after being
convicted of 4 counts of Burglary with intent to rape and sentenced in 1982 to 10 years.
Enard was also convicted on three counts of Sexual Assault when he received his 10 year
sentence and was serving a 75 year sentence since 1986 for Aggravated Kidnapping and
Aggravated Sexual Assault when paroled last month.
Detectives report that Emard has family in Houston, Texas and Lafayette, Louisiana.
Enard is considered a sexually violent predator and at high risk to reoffend.

Jeffrey Barth
failure to report
Jeffrey Barth is currently being sought by the Washington State Department of Corrections
on a warrant charging him with failing to report to the department. He was being supervised
for first-degree kidnapping. Barth had been convicted of kidnapping in connection with the
murder of a young woman that was stuffed into a duffel bag driven to a remote location and
shot dead. Barth who was present at the time of the crime, was allowed to plead guilty to
kidnapping in exchange for his testimony against his accomplices.
Barth faced up to life in prison had he been convicted of the
original charges of first-degree murder, first-degree kidnapping
and conspiracy to commit first-degree kidnapping. By pleading
guilty to the reduced charge, he received a reduced sentenced.

that would detect early stages of pancreatic cancer.

The Oakland Police Department is asking for the public’s help in identifying the person in this
surveillance video. Detectives report that this person allegedly shot and killed a 17 year old
boy execution style in broad daylight. The video shows the masked gunman shoot the boy who
falls to the ground and then shooting into the street at other persons. He then he fires several
more shots at the teen, point blank, as the boy lays on his back and puts his hands in the air.

An arrest has been made in connection with the murder of a 20-year-old man at a Pittsburg
gas station in January, police said today. Renard Curry, 19, was arrested for the Jan. 29 killing
of Timothy Smith Jr. at a Union 76 gas station, located at 2150 Railroad Ave., police said.
The 9 a.m. shooting sent customers running and left Smith with a gunshot wound to the head,
police said. He died later that day. Curry’s brother, Robert Grant, 24, is also sought in connection with the murder.
Other suspects have also been arrested in connection with the murder, Pittsburg police Lt.
Ron Raman said, but their identities are not being made public. Police said Grant is considered armed and dangerous and knows that police are looking for him. He is a San Francisco
resident who frequents the East Bay area.

Apprehended
A prison inmate who escaped from the Mansfield Correctional Institution has
been captured. James David Myers was recognized by a citizen, as the escapee was shopping at the Olivesburg General Store in Ashland, Ohio.
The inmate was serving a life sentence for kidnapping, rape and other crimes.
Myers was recognized when he walked into the Olivesburg General Store in
Ashland.
The citizen dressed in an American flag shirt for the 4th of July tackled, tied
up and held Myers until police arrived to arrest him.
The incident was caught on tape by the
stores surveillance camera.

that two teenage girls were arrested in
connection with the robbery of a 68-yearold woman aboard a San Francisco Muni
vehicle. The robbery occured on June 11
in the city’s Bayview District.
Police released video footage that
showed the woman sitting in the front of
the Muni train when two juvenile girls approached her, punched her, grabbed her
two purses, then fled.
The girls remained at-large until
Fugitive Watch received a tip about the
identity of one of the girls. Acting on the
tip, police found the girl already in custody for a separate case.
She was re-booked for the robbery.
The second suspect turned herself in
to police. The girls’ names are not being
released because they are juveniles.

San Francisco police released a sketch of a suspect who attacked a man near Dolores Park,
causing serious head injuries. The attack occurred sometime between 12:45 a.m. and 1:15
a.m. in the first block of Hancock Street, just west of the park, police said. The victim saw
that the suspect, possibly a homeless man, was preparing to spend the night in front of a
home and asked him to sleep in a different spot, according to police.
The suspect then became aggressive with the victim, who said he was going to call police.
But before he had the chance, the suspect knocked him to the ground, causing the head
injuries. The victim was taken to San Francisco General Hospital to be treated and has
since been released, according to police. The suspect fled and has not been found. He was
described as a White man about 6 feet 2 inches tall and weighing about 200 pounds. He had
curly brown hair and was last seen wearing a dark jacket, dark pants and a baseball hat,
police said.

The San Jose Police Department is asking for the public’s help in identifying and locating a
suspect involved in a recent robbery. On May 17, 2013 at approximately 11:36 P.M., the suspect
entered a business located on the 5800 block of Cottle Road in South San Jose.
The suspect was armed with a weapon and demanded money. The suspect fled the store with
an undisclosed amount cash and was last seen running away on foot. The unidentified suspect
has not been located and remains at large.
The suspect is described as a black male adult, early twenties, 5’08″ 150 lbs, black hoodie,
blue/black jeans, black shoes with white stripes.

Police have released sketches of a man who is suspected of robbing a market in Scotts Valley,
according to police. Police are seeking a suspect in connection with the armed robbery.
According to police, a man armed with a handgun robbed the Scotts Valley Market, located at
14 Victor Square.
The suspect purchased two items and then drew a handgun and demanded money from the
register. The clerk gave the suspect an undisclosed amount of cash and the suspect ordered
the clerk to the ground, police said. The suspect then fled the store on foot in an unknown
direction and has not been found, according to police.
The suspect was described as a Hispanic man between 30 to 36 years old who is between
5 feet 10 inches and 6 feet tall. The man had a Band-Aid on his left cheek and a tattoo on
his neck. He was wearing a gray or brown baseball hat, dark blue jeans, a black or dark blue
hooded sweatshirt with white lettering that read “Cali” and blue Vans-type shoes with white
laces, police said.

The Phoenix Police Department is asking for the public’s help in identifying the suspects in this
video. Detectives report that on Monday, May 20, 2013 at approximately 10:05 AM the these
suspects entered the business wearing all dark clothing, faces covered, and weapons drawn.
They then allegedly immediately ordered the store employees and customers to lie on the
ground. One of the suspects jumped on top of the counter with a gun in his hand while the
other suspects broke the glass display cases, removed jewelry and placed it in canvas bag.
The suspects fled the business in an unknown direction. The robbery was caught on camera.

The Berkeley Police Department is asking for the public’s help in finding a wanted man who
allegedly assaulted a female victim. According to detectives, on June 23, 2013, at about 9:30
a.m, Martin allegedly entered a multi-unit residential building in the 2400 block of Piedmont
Avenue and prowled through several rooms. The victim was asleep in bed when the suspect
entered her room and began inappropriately touching her, causing her to wake up. The victim
started yelling and the suspect fled the building.
A subsequent investigation identified Martin as the alleged suspect.

Vallejo police have identified a suspect in a February homicide as 32-year-old William
Cordoba and are seeking the public’s help in locating him. Cordoba, also known as William
Johnson, is suspected of killing 27-year-old Jimmie Richardson on Feb. 4, police Capt. Jim
O’Connell said. Richardson’s body was found on the west sidewalk of Evelyn Circle north of
Borges Street around 4:20 a.m. that day. He had been shot multiple times.
Richardson’s killing marked Vallejo’s first homicide of 2013. There have now been a total of
12 homicides. The city’s most recent killing occurred when a woman was fatally wounded by
shots fired into a Frisbee Street home, police said. Two other people, a man and a woman,
were injured in that shooting and were taken to hospitals. An 18-year-old man who was
attending a child’s party was shot in the driveway of a home in the 100 block of Sawyer
Street. A family member took the man to a hospital, where he died around 1 a.m. Sunday, Lt.
Ken Bartlett said. His name has not been released. Vallejo police also have not released the
names of two people who died on June 1 when four people were shot during a party in the
100 block of Linfield Drive. The other two victims were injured but survived.

The Philadelphia Police Department is asking for the public’s help in identifying the suspect in
this video. Detectives report that June 10, 2013, at 3:44 pm, the victim, a 43 year-old female
was inside the Magic Nail Salon in Upper Kensington receiving a nail treatment.
During her treatment, an unknown white female who was in the company of a female juvenile
allegedly appeared to instruct the child to remove the victim’s wallet containing various
identification, Wells Fargo and Citi Bank cards from her purse. After taking the victim’s wallet
the suspect placed the wallet into a bag.

Movie Critics Corner: Game of Thrones

With it’s third season recently concluded with an audience of roughly five million
viewers, the immensely popular Game Of
Thrones series has proven to be one of
the most recent and successful established franchises in contemporary pop
culture. Based on George R.R. Martin’s
A Song Of Ice And Fire series of novels,
HBO adapted the first novel for television back in 2011 to a massive audience
and critical acclaim. Set on the fictional
landmasses of Westeros And Essos, the
plot concerns a wide array of characters
and their interweaving stories in the feudal
“Seven Kingdoms” and beyond in their
hostile world of political intrigue, supernatural forces, and the claim for “The Iron
Throne” which is deeply coveted by many
for its power and authority over the realm.
With five books in the series and two
tentatively planned, a television adaption
fits the series well and serves the source
material better than and film adaption
could have. The first two seasons are
based on the first two books in the series
while the third season is based on the first
half of the third book, A Storm Of Swords.
Each season is ten episodes long, each
an hour long which provides plenty of
room to be faithful to the novels itself
without having to sacrifice much because
of run time constrains. It’s obvious that the
production team worked tirelessly to make
the screen adaption as faithful to the novel
as possible and what little I’ve read of the
series I can say it is as close of an adaption as I’ve seen of any work. George
R.R. Martin’s written world is vast, varied,
and well developed; several different
locations we’re used for filming including Iceland, Morocco, Croatia, Northern
Ireland which give the locations onscreen
a very distinct visual appearance. Costumes, props, and set work are elaborately detailed and make for a convincing
immersion of a lived in fictional world with
a back story of thousands of years.
George R.R. Martin’s series is clearly
inspired by Lord Of The Rings but contrasts in several key aspects. Where
Tolkien’s world was perilous and hostile,
its appeal was with all age groups. Just
about each episode of Game Of Thrones
makes the most of its M rating. However this also gives it the opportunity to
discuss certain social issues in a fantasy
genre such as feminism, social status,
moral ambiguity, sexuality, slavery and
so on. Each character has their own
strengths and weaknesses, ambitions
and motivations. A few episodes in, viewers will realize not to get too attached to
anyone as characters die as often as new
ones are introduced. Weather your reading the novel or watching the adaption,
Game Of Thrones is extremely captivating with an immensely active fanbase. Its
practically required watching for anyone
who enjoys fantasy or binge television in
general.
